Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. Comments:
An unannounced, on-site focused inspection was initiated on 08/26/2024 and completed on 08/26/2024, as a part of the current licensure period. The on-site inspection began at 12:42pm and ended at 1:06pm. The inspector reviewed compliance in the areas listed above. There were 8
children present and 2 caregivers; the point total was 20. This inspection included a tour of the facility.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-800-420-A
Description: Based on observation, rooms, halls, and stairways used by children in care were not lighted with natural or electric lighting for the children's safety and comfort.

Evidence:
1. The electric lighting in the room that infant and toddlers were napping were turned off during nap period.
2. The windows for natural light were covered with curtains.
3. The room was very dark and the inspector was not able to see the infants, toddlers and 3.5 year old children sleeping in their cribs.

Plan of Correction: The provider will open the curtains to provide natural light during nap.

Standard #: 8VAC20-800-520-A
Description: Based on observation, cribs were not used for children from birth through 12 months of age.

Evidence:
1. Two children (3.5 years old and 2.5 years old) were both over the age of 12 months and observed sleeping in cribs.
2. The two children were not provided a cot, rest mat, or bed to sleep.

Plan of Correction: Will provide rest mats.
