22.1 Background Checks Code, Carbon Monoxide

Technical Assistance:
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements.

Comments:
An unannounced, on-site renewal inspection was initiated and completed on 9/24/2024. The on-site inspection began at 11:50am and ended at 12:55pm. The inspector reviewed compliance in the areas listed above. There were 12 children present and 3 staff with a total of 43 points. Ages range from 4months to 2 years. The inspector reviewed 4 children?s records, 3 staff records on-site and 1 household member record. This inspection included document review, tour of the facility, interviews and observations.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-800-60-B
Description: Children?s records are required to have written authorization for emergency medical care should an emergency occur and the parent cannot be located immediately.

The record for Child #1 did not have written authorization for emergency medical care should an emergency occur

Plan of Correction: Child record will be corrected at pick-up on 9/24/2024.

Standard #: 8VAC20-800-210-A
Description: Caregivers shall obtain a minimum of sixteen clock hours of training annually in areas relevant to their job responsibilities.

Staff #1 and Staff #2 had only completed 6 hours of annual training from September 2023 to September 2024.

Plan of Correction: Assistants will have training completed by next week.

Standard #: 8VAC20-800-540-A
Description: Highchairs shall be used according to the manufacturer?s instructions and when occupied by a child, a safety strap shall be used and securely fastened.

There were 7 children observed in highchairs and 3 children did not have the safety straps securely fastened.

Plan of Correction: Caregivers will remember to strap children in highchairs during use.
