22VAC40-191 Background Checks (22VAC40-191)
An application to operate a Child Day Center was submitted to the Piedmont Licensing Office. The initial application was reviewed and a site inspection was conducted on May 18, 2015. At that inspection, it was determined that the Center did not meet the minimum Standards for the required number of sinks and toilets. The application process was placed on hold, the Licensee requested time to add an additional bathroom in the building. This LI verified on August 18, 2015 that the Center had added a sink and toilet in the building. Documents were received by fax on September 10, 2015 which completed the application. This LI inspected the building, reviewed staff records and the Center's written policies and procedures.
Standard #: 22VAC40-185-70-A Description: Based on reviewed documentation by the LI, the Licensee failed to obtain current background checks as required by the regulation entitled Background Checks for Licensed Child Day Centers (22VAC15-51). Evidence: The LI reviewed a sample of 5 staff members' records. The background checks presented for staff #5 were dated past the 12 month time frame: the sworn disclosure was dated 06/14/2014; criminal record check dated 07/30/14 and the Search of the Central Registry dated 07/21/2014. Documentation of the Center's Staff information sheet was received 09/10/2015. Plan of Correction: The Licensee will submit documents to obtain current background checks.
