63.2 Licensure and Registration Procedures
An unannounced other inspection was done today August 20, 2015 in response to an alleged incident reported to the licensing office by the center director. The incident reported was that a child who attends the center had stated he had been inappropriately touched at school. The inspector interviewed staff at the center during the inspection. The inspector also obtained information from a representative of the local social service agency. The inspector determined from information obtained that no child day center standards were in violation therefore the complaint is invalid. There were other violations cited during the inspection not related to the actual complaint. These violations were discussed with the director as well as corrective action. Standard #: 22VAC40-185-130-A Description: Based on observation the center failed to obtain a child's immunization prior to attendance. Evidence: 1. During the inspection the LI reviewed the file of child #1 who began attending the center on 8/3/2015 and there was no immunization form in the file. Plan of Correction: The Director indicated she will obtain the immunization forms prior to the first day of attendance of any new children.
Standard #: 63.2-1720-F Description: Based on observation the center did not ensure that staff without a original criminal history record always be in direct supervision of another employee for whom a background check has been completed, while supervising children. Evidence: 1. During the inspection the LI observed that staff # 5 was the only staff in the two's classroom. The LI asked where was the teacher and staff# 5 indicated down the hall in the kitchen.The LI then walked back down the hall past the kitchen and then immediately came back down the hall and then saw the teacher, staff # 2 enter her classroom. She indicated when asked by the LI that she had just gone to the kitchen to get the medicine box. When the LI reviewed the file of new staff # 5, the criminal history check had not been returned. Plan of Correction: The director indicated she will no longer allow this to happen, She was not aware of the change in the code and would not let new staff be alone with the children at any time. She will have a floater staff available or instruct staff to let new staff run errands out of the classroom.
