Discussed new provisional background check requirements for staff.
Effective January 1, 2025, the VDOE will begin determining compliance with ? 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. An unannounced, on-site monitoring inspection was initiated on 10/11/2024 and completed on 10/11/2024. The on-site inspection began at 9:38 am and ended at 11:20 am. The inspector reviewed compliance in the areas listed above. There were 7 children present and 2 caregivers; the point total was 17. The inspector reviewed 7 children's records and 5 caregiver/household member records on-site.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the family day home.

Standard #: 22.1-289.035-A Description: All employees and applicants shall undergo a background check in accordance with subsection B prior to employment and every five years thereafter.
The central registry check and sworn statement of affirmation for caregiver 1 has not been updated every five years as required. These background checks expired in August of 2024.Plan of Correction: The provider stated that updated background checks will be completed and requested immediately.
Standard #: 22.1-289.036-A Description: Any adult living in such family day home shall undergo a background check in accordance with subsection B prior to issuance of a license as a family day home and every five years thereafter.
Household member 1 has not obtained an updated central registry check and sworn statement or affirmation every five years as required. The central registry check expired 10/1/2024 and the sworn statement or affirmation expired 8/10/2024.Plan of Correction: The provider stated that updated background checks will be completed and requested immediately
