An announced "other" inspection was conducted on 10/28/2015 in response to a self reported incident of a young child leaving his designated classroom without staff knowledge. Based on the information gathered this report is found to be valid. A violation of Standard 340.A has been cited. Please complete the "plan of correction" for each violation cited on the violation notice and return it to me within 10 calendar days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word "corrected" is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).
Standard #: 22VAC40-185-340-A Description: Based on staff interviews the center failed to ensure that when staff are supervising children, they shall always ensure their care and protection. Evidence: 1. On October 20, 2015 at approximately 3:45pm staff #1 observed a 17 month old child walk past her while standing in the front right area of the school age classroom. Child #1 was walking into the school age area toward the stage. a. The floor plan of the center is open and the school age room opens to the lobby area of the center. A divider is placed in the middle area of the lobby creating both a left and right entrance area into the school age classroom. b. Staff #1 noted child #1 was alone and had come from the direction of the toddler classroom. c. Staff #1 asked the school age staff (staff #2) if she was responsible for child #1. Staff #2 indicated she was not. d. Staff #1 took child #1 to the toddler classroom and asked the toddler staff (staff #3 and staff #4) if they were aware that child #1 was not present in the toddler classroom. Staff #3 and staff #4 confirmed they were not aware that child #1 was not physically present. 2. Staff #3 stated that staff #4 had left the toddler classroom at approximately 3:45pm for approximately one minute. Staff #3 stated she was at the table making an art project with the children and noted that the classroom door was open during the time that staff #4 was gone. Staff #3 further stated she assumed that staff #4 was standing on the other side of the door and therefore, did not get up to close the classroom door. a. Staff #3 allowed that she did not actually see staff #4 standing outside the door as she was sitting at the table which is located in the middle of the classroom. b. Staff #4 returned approximately one minute later and resumed assisting with the art project. c. Shortly thereafter, staff #1 came into the classroom with child #1. Staff #3 confirmed she was not aware that child #1 had left the classroom nor did she know how the child exited the room without her knowledge. 3. Staff #4 confirmed she had left the classroom for approximately one minute in order to provide some information to the program director. (staff #5) Staff #4 stated she walked out into the lobby area of the center and relayed this information from the middle of the lobby area near the left area entrance to the school age room. a. Staff #4 stated that child #1 was physically present when she left the classroom. Staff #4 recalls seeing child #1 when she returned to the room as she took attendance. b. After taking attendance, staff #4 stated she went to the table to assist staff #3 with the art activity. It was at this time that staff #1 came into the classroom with child #1. c. Staff #4 confirmed she was unaware that child #1 had left the classroom without her knowledge. Additionally, staff #4 stated she did not know how child #1 got out of the classroom. 4. Staff failed to provide for the care and protection of child #1 as child #1 was able to exit the toddler room without their knowledge. Child #1 was retrieved by staff #1 who was visiting the center in an administrative capacity. Staff #1 is employed by KinderCare however, this individual was not responsible for the supervision and care of children in the toddler classroom. Plan of Correction: Proper procedures were taken with staff members involved. Entire staff retrained on proper supervision of children and ensuring CSR checks are completed and accurate. CD and AD responsible for checking classroom CSR's a minimum of 3x per day. Corrected immediately following investigation.
