22VAC40-185 STAFFING AND SUPERVISION.

It is highly recommended that a staff training regarding appropriate behavior guidance and handling frustration in the classroom be scheduled immediately.
The Inspector was on site today after receiving information from school management personnel regarding an incident involving inappropriate staff:child interactions in the classroom. Staff interviews were completed today. In addition, the Inspector viewed school security video footage from the classroom on the day in question. The reported concerns were addressed today and found to be valid. Additional violations not directly associated with the report were also cited during this investigation. This investigation was conducted between approximately 9:15 am and 11:40 am. Thank you for meeting with me today. Standard #: 22VAC40-185-160-A Description: Based on a review of staff health records, it was determined that one record is not complete. Evidence: The record for Staff A does not include a TB Health Screening report. Although the staff member ended employment at the center on 12/18/15, her documented date of hire was 8/17/15. Plan of Correction: She was asked many times to bring the TB documentation. In the future, I will make sure all files for new employees are complete prior to their first day of employment.
Standard #: 22VAC40-185-60-A Description: Based on a review of children's records, it was determined that one record was not complete. Evidence: Child record #1 includes the information for only emergency contact person, other than the parents. Plan of Correction: I will ask the parent to update the information on the registration form.
Standard #: 22VAC40-185-240-A Description: Based on a review of staff training documentation, it was determined that one orientation document was not completed with all required information. Evidence: The First Day Orientation Training documentation for staff A is not dated to indicate the day the orientation was completed. Plan of Correction: I will update the documentation. In the future, I will make sure all documentation for new employees is completed before their first day of employment.
Standard #: 22VAC40-185-400-B Description: Based on staff interviews and a review of classroom security video footage, it was determined that on December 16, 2015 one staff person engaged in inappropriate behavior guidance. Evidence: On December 16, 2015 staff person A engaged in inappropriate behavior guidance while supervising the 3 year old children during nap time. On this occasion, the staff person is seen on video footage displaying frustration and an extreme lack of patience when child 1 resisted taking a nap. As the child was moving around on his cot, staff person A walked over to his cot and proceeded to grab his blanket away from him then pull it off the cot in an aggressive manner, possibly leaving a mark on the back of the child's neck in the process. After pulling the blanket away, staff person A proceeded to grab the cot and yank it up off the floor, causing the child to roll and fall off the cot then land on the classroom floor. After grabbing the cot, the staff person is then seen walking to the door that leads to the outside, opening the door, then presumably placing the cot outside. At the same time, the child is seen jumping up and down in clear distress that his cot was no longer in the classroom. The child walked back to the spot where his cot should have been and proceeded to cry. During this time, staff person A is seen ignoring the child and continuing to eat her lunch. Approximately 3 minutes later, the cot is seen back in place with the child lying on it. The actions of staff person A indicate inappropriate behavior guidance, as her actions were not constructive in nature, not age and stage appropriate, and were not intended to redirect the child to appropriate behavior. Plan of Correction: The staff member was immediately terminated. All staff have now gone through an additional training regarding appropriate behavior guidance & handling frustration in the classroom. [sic]
