During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Technical Assistance:
* Discussion that effective January 1, 2025, VDOE began determining compliance with 22.1-289.057 of the Code of Virginia, which is legislation passed by the General Assembly in 2020. The law requires all licensed child day programs, religious exempt child day centers that serve preschool age children, and certified preschools to test potable drinking water. The law requires that programs submit their plans and test results to the Virginia Department of Health Office of Drinking Water (VDH ODW) and the Superintendent by December 31, 2024. If the results of the testing indicate elevated lead levels, the program shall remediate, retest, and resubmit results to VDH-ODW and the Superintendent. There is an additional alternative bottled water option that comes with additional requirements. The statutory requirement can be found online at https://law.lis.virginia.gov/vacode/title22.1/chapter14.1/section22.1-289.057/. Resources are available online at https://www.childcare.virginia.gov . Please send all water testing plans and lead testing results to: leadtestingprogram@vdh.virginia.gov. LI has agreed to send some water testing information to the Provider. However, please see our website for the complete information.

* Effective 12/09/2024, the Office of Background Investigations implemented changes to their provider portal. Please note that all providers will need to create an account to request Central Registry background clearances. Please contact OBI directly if you have questions or concerns. Here is a caption from the memo that was sent on 12/04/2024: Both current and new users will need to register a new account to access the new OBI Provider Portal after December 9, 2024, to ensure all features of the enhancements are applied to user accounts. Registration will create an account with up to 5 authorized users and will allow the primary account user to update account access and facility contact information as needed.

Comments:
An unannounced, on-site monitoring inspection was initiated and completed on 03/21/2025. The on-site inspection began at 9:30 am and ended at 11:30 am. The inspector reviewed compliance in the areas listed above. There were (11) children present and (#) caregivers; the point total was (27). The inspector reviewed (12) children?s record, (3) caregivers records, and (1) household member record on-site on 03/21/2025.

This inspection included: document review (i.e. files, no Injury logs on site, policies and procedures, emergency drill logs); tour of the facility; interviews; and observations.

Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-800-920
Description: When meals or snacks are provided by the Family Day Home (FDH), the menu for the current one-week period.

While the Provider stated that the information is communicated verbally to each parent, a menu for the current week was not posted either on site or on-line.

Plan of Correction: A weekly menu shall be posted.

Standard #: 8VAC20-800-100-A
Description: The Provider shall obtain documentation of a physical examination prior to a child's attendance or within 30 days after the first day of attendance.

There were no physical exam records available for Child #11, who had been in care for over 9 months.

Plan of Correction: A physical shall be obtained and placed on file.

Standard #: 8VAC20-800-70-B
Description: Before the child's first day of attendance, the provider shall obtain the parent's written acknowledgement of the receipt of the information regarding family day home operations and administration.

There were no parent acknowledgements (Medication Administration ? Decision to Administer form) available for Child #6 and Child #10. Both children have been enrolled for over 6 months.

Plan of Correction: This form shall be completed for each child in care and placed on file.

Standard #: 8VAC20-800-530-I
Description: Mattresses, when used, shall be covered with a waterproof material that can be cleaned and sanitized.

Three (3) mattresses (used by the children in care) were each observed with rips on their surface; exposing the padding underneath. Thus, rending it no longer waterproof.

Plan of Correction: These mattresses will be replaced.
