22VAC40-191 Background Checks (22VAC40-191)
An uannounced monitoring inspection was conducted from 9:00am-11:30am. Upon arrival there were 63 children in care with 9 staff present. A sample of 2 staff and 2 children's records were reviewed in addition to 6 medications. Children were observed during morning snack and an Easter Egg hunt on the playground.
Standard #: 22VAC40-185-140-A Description: Based on a record review the center failed to ensure each child had a physical examination. Evidence: Child #1, enrolled 04/01/13, did not have documentation of a having a physical examination. Plan of Correction: The child had a shot record therefore has had a physical. The director will contact the parent today and request a copy of the child's last physical exam.
Standard #: 22VAC40-185-70-A Description: Based on a record review and interview the center failed to ensure all required information was kept for each staff person.
Staff #2 did not have a record that included a hire date, emergency contact, 2 references checked prior to employment or qualifications. The director stated she was hired to work in the office.
Plan of Correction: Staff #1 did receive an orientation, however it was not documented. The director will document the orientation and have the staff sign it this week. Staff #1's hire date will be documented in the record today. Staff #2 has worked for the center in the past and a record is in the attic. A new file for staff #2 will be created with all required information by the end of next week.
Standard #: 22VAC40-185-270-A Description: Based on observation the center failed to ensure areas and equipment of the center, inside and outside were maintained in a safe condition. Evidence: There was sporadic areas of peeling paint in the red climber located on the playground. Plan of Correction: The red climber will be lightly sanded and repainted. The director will continue to monitor.
Standard #: 22VAC40-185-430-C Description: Based on observation the center failed to ensure play equipment met all the requirements. Evidence: An s-hook on the swings was open more than the thickness of a penny. Plan of Correction: The director will have all swing hooks tightened.
Standard #: 22VAC40-191-60-C-1 Description: Based on a record review and interview the center failed to ensure all employees had a criminal record check within 30 days of employment.
1. Staff #2 did not have documentation of a criminal record check. An exact hire date was unable to be confirmed. The director stated staff #1 was hired in January 2016.
Plan of Correction: The criminal record checks were sent but were returned. By mistake the director did not realize they were returned unstamped and with no findings. They will be mailed by the end of the day.
