22VAC40-185 STAFFING AND SUPERVISION.
The inspector conducted an Other inspection in response to a report that was received on 3/28/16. On April 6, 2016, an unannounced inspection was conducted to investigate a self-reported, significant issue, at the facility, regarding supervision of a child. Management was interviewed regarding a child being left unattended on the playground. Written policies and procedures were reviewed. Based on facts obtained during the inspection, violations were cited. Areas of noncompliance were found in administration and staffing and supervision. The violations are identified on the violation notice and will will be discussed with the director at the exit interview. It is requested that you please complete the columns for ?actions to be taken? and ?date to be corrected" for the violations cited on the violation notice. Include steps to correct the noncompliance; measures to prevent it from occurring again; and person responsible for implementing each step and/or monitoring any preventive measures. Standard #: 22VAC40-185-40-E Description: Based on interview, the facility did not ensure that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department. Evidence: 1. Staff #1 (center director) reported that staff #2 failed to follow the center's policy regarding children's safety. Staff #2 took the children inside the building without doing a name-to-face check before leaving the playground. The failure of the staff to comply with the center's policy and procedures resulted in a three year old child being left on the playground for less than five minutes on the afternoon of 3/24/16. 2. The center's policy is that staff are required to conduct a name to face check and document it on the name to face sheet every 30 minutes and every time the class or a child changes location. Staff are a required to document when a child leaves a location and when they arrive at a location. Staff #2 failed to conduct the name to face check and complete the documentation at the time that the children were leaving the playground. Staff #2 completed the Name-to-Face check and documentation after the children arrived in the classroom. Plan of Correction: All corrections took place on or before 3/30/16 1. Staff #2 was taken off of the work schedule on 3/24/16 and her employment was ended. 2. An emergency staff meeting was held on 3/30/16 with all staff members to review the Name-to-Face policy and ensure that it is being implemented properly. 3. Staff members, have always been and will continue to be extensively trained on the Name-to-Face policy when they are hired. 4. Name-to-Face policy, has always been and will continue to be reviewed frequently throughout the school year at mandatory monthly staff meetings
Standard #: 22VAC40-185-340-A Description: Based on interview, the facility did not ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance. Evidence: 1, Child #1, whose date of birth is 4/2/12, was left on the playground for less than 5 minutes on the afternoon of 3/24/16. 2.Staff #1 (center director) reported that staff #2 was supposed to unlock the door, then do a name to face check of the children using the name to face sheet, while the door was open, and make sure that she had all of her children before entering the building. 3. Staff #1 reported that staff #2 took the children to the classroom first, then did the name to face check, at which time she realized that child #1 was missing. Staff #2 then checked the bathroom, but child #1 was not there either. Staff #1 checked the playground and found child #1 playing in the sand. Plan of Correction: All corrections took place on or before 3/28/16 1. As of Monday, 3/28/16, ?traveling ropes? are to be used when moving children to or from a location in addition to the Name-to-Face checks that will continue to be implemented in accordance with the center?s policy. 2. Upon speaking with Child #1?s family, we have come to understand that this behavior (staying outside when he is expected to come inside) is something he does often at home. As of Monday, 3/28/16, this child holds the teacher?s hand when moving to and from a location.
Standard #: 22VAC40-185-340-F Description: Based on interview, the facility did not ensure that children under 10 years of age always shall be within actual sight and sound supervision of staff. Evidence: The center director reported the following incident to the licensing inspector on 3/28/16: 1. Child #1, whose date of birth is 4/2/12, was left unattended on the playground for less than 5 minutes. 2. Staff #2 went outside with 6 children, ages 3 years and 4 years, at about 4:30 p.m. 3. At about 5:00 p.m., staff #2 called the children to line up along the wall outside of the door to their building, Child #1, who likes to stay outside, finally joined the line. 4. Another child said that he had a poopy accident and was upset. 5. Staff #2 entered the code to unlock the door and the children entered the building. 6. During the commotion of one child being upset and staff #2 unlocking the door, child #1 returned to the playground. 7. When staff #2 opened the door, the child who had the potty accident went to the bathroom which is across from the door. Another teacher assisted that child. 8. Staff #2 walked to her classroom with the other children. 9. In the classroom, staff #2 did a name to face check and did not see child #1. 10. Staff #2 checked the bathroom to see if child #1 had gone in with the child who had the accident. 11. Staff #2 did not find the child in the bathroom and went outside where she found child #1 with a shovel and bucket playing in the sand. Plan of Correction: All corrections took place on or before 3/30/16. 1. An emergency staff meeting was held on 3/30/16 with all staff members to review the events of 3/24/16, review the Name-to-Face policy and ensure that it is being implemented properly. 2.
