22VAC40-185 STAFFING AND SUPERVISION.
On 5/02/2016 an investigation was initiated with other agency officials regarding self-reported concerns of a child with bruises on her arm. Staff were interviewed and video camera recording (without audio) was viewed. Other visits to the center were conducted on 05/10/2016 & 06/08/2016 for additional interviews and review of the video camera recording, violations were cited related to the nature of the concerns. Standard #: 22VAC40-185-340-A Description: Based on video documentation, it was determined that center staff failed to ensure care, protection and guidance while children were in their direct supervision. Evidence: 1. On 4/21/2016, Child #1's parent reported finding unexplained bruises on child's left arm and immediately notified the proper authorities. 2. The video recording of 04/21/2016 in the Junior K-Prep (3-4 year old)classroom showed Staff#1 & Staff #2 roughly grabbing children by the arm, and forcefully pushing/pulling on children. 3. Staff #1 was observed in the video recording roughly grabbing Child #1 by the left arm and removing Child #1 from her seat by lifting her up off the ground by the one arm and moving her to the front of the classroom. Plan of Correction: Hopkins House has a zero tolerance policy, (100.39 Child Abuse & Neglect), as it relates to suspected or actual abuse of children by staff. With this policy in place, both staff were immediately terminated. . All Hopkins House staff took a refresher course on Guiding Children's Behavior on 5/19/2016 to reinforce all previous training. Prior to this incident staff were trained on 4/8/16 on positive guidance and redirection techniques at a joint staff meeting.
Standard #: 22VAC40-185-400-B Description: Based on video documentation, it was determined that the center staff failed to provide age & stage appropriate behavioral guidance when attempting to redirect children. Evidence: 1. On 04/21/2016, in the Junior K-Prep (3-4 year old) classroom, Staff#1 & #2 were recorded on video cameras not using appropriate behavior guidance while redirecting children. At approximately 9:01am, Staff #2 was observed with a group of 4 children cleaning up at the block station. When Child #2 pulled out additional toys instead of cleaning up, Staff #2 immediately yanked/grabbed Child #2's arm while attempting to redirect Child #2 to assist with clean-up. Staff #2 lifted Child #2 up off of the ground and dragged the child to the front of the classroom to the circle time mat. 2. At 10:26am, a group of 4-5 children were observed playing at the table top station with Staff #1. Staff #1 was observed kicking/throwing chairs to the table and slamming toys on & under the table. Then children were observed being pushed/shoved under the table to clean up the toys after Staff #1 threw the toys down on the floor. Plan of Correction: . In an effort to curtail potential incidents, both Principal and Assistant Principal are now required to review four hours weekly of video of 2 classrooms, spend at least 30 minutes of in-class observation, and provide feedback to staff. Evidence of these corrective measures are accessible and regularly reviewed by the Central Administration.
Standard #: 22VAC40-185-410-1 Description: Based on video documentation, it was determined that the center staff used forbidden action of physical punishment with children in care. Evidence: 1. On 04/21/2016, at 8:53am in the Junior K-Prep (3-4 year old) classroom, Staff #2 was recorded forcefully flicking/hitting child #2 in the forehead with Staff #2's open hand. 2. At 9:10am, Staff#1 was observed on video roughly grabbing Child#1 by the left arm and lifted up off the floor, and carried by Staff #1 by the one arm approximately 3 ft. across the classroom & forcefully placed the child #1 in the teacher's chair near the front entrance to the classroom. 3. At 10:23am, Child #3 and two other children were observed at the front of the classroom near the circle time area playing. Child #3 and one of the children began pushing each other. Staff #1 was observed getting up from her seat at the table toys area & rushing up to the front of the classroom near the circle time area. Staff #1 then roughly grabbed Child #3 by the left arm & pulled the child, forcing the child to walk to the table toys area. Plan of Correction: Weekly teacher meeting will continued to be held in an effort to ensure that teachers are supported when they are faced with challenging behaviors where their team members can offer suggestions for alternative behavior modification plans. An outside consultant will regularly meet with staff to provide additional support and feedback to teachers.
