22VAC40-191 Background Checks (22VAC40-191)
An unannounced complaint inspection was done today June 24, 2016 in response to a complaint received from the local social service department. The complaint reported was that it was observed in the infant area there was one staff to more than ten infants. On the day of the inspection, upon arrival the inspector determined there was one staff to seven infants. This was over the required ratio of one staff to four infants. This observation along with interviews with staff provide evidence to warrant violations in the standards. Other violations were also cited during the inspection that were not related to the reported complaint. The violations and corrective action were discussed with the director at the exit interview. Standard #: 22VAC40-185-340-D Complaint related: No Description: Based on observation the center did not have a lead teacher in each grouping of children. Evidence: 1. During the complaint inspection the inspector observed staff # 2 was in charge of the toddlers who were napping upon arrival at 1: 50 PM. It was also verified through a review of five staff files and further discussion with the director and staff # 2 & 3 that during the majority of hours the center is open there is only one staff who meets the lead teacher qualifications and she is in the infant room. Plan of Correction: The director misunderstood the standard for staff # 3. Documentation will be obtained to verify lead teacher qualifications. Have rearranged schedules so two lead teachers are in the baby house at all times.
Standard #: 22VAC40-185-350-E-1 Complaint related: Yes Description: Based on observation and interviews the center did not maintain the staff to child ratio in the infant house at all times. Evidence: 1. During a complaint inspection the inspector observed at 1:50 PM there was one staff with seven infants. The ratio of one staff to four infants was not met. This first occurred at noon when the lead teacher left to go on lunch break, leaving an aide to care for the infants. Then, when the lead teacher returned at 1:30 PM, staff # 3 left for the day. This was verified through discussion with staff # 2 & 3. These staff members also verified that there was only one staff with the infants when the lead teacher left for lunch break at noon. Plan of Correction: Will review with staff the importance of communicating with each other at all times throughout the day regarding staff present and ratios.
Standard #: 22VAC40-191-60-B Complaint related: No Description: Based on observation and review of staff files the center did not have sworn disclosure forms on all the hired staff. Evidence: 1. Based on a review of the five staff files, staff # 2 was hired 3/23/16 and there was no sworn disclosure form for this staff member. Plan of Correction: During the inspection staff # 2 completed a sworn disclosure statement and it was placed in her record.
Standard #: 22VAC40-191-60-C-2 Complaint related: No Description: Based on a review of staff files the center did not obtain a child protective service registry form on all staff . Evidence: 1.During the inspection the inspector reviewed five staff files and staff # 5 was hired 8/21/15 and the child protective service form was not received until 2/26/16. Staff # 6 was hired 5/16/16 and the child protective service form had not been received within thirty days of hire. Plan of Correction: Director had sent the form for staff # 6. Called and verified it was not received. Mailed again on 7/1/16 & documented in the file. Had originally sent for staff # 5 but no follow up was done. Will monitor more closely and document.
