22VAC40-191 Background Checks (22VAC40-191)

An unannounced monitoring inspection was completed on 8/29/16. There were 15 children present with two staff supervising. The regular teacher was absent and the regular assistant had not started working. There was a substitute teacher and a substitute assistant. Four children's records and three staff records were reviewed. The inspector arrived at the center at 10:00 am and departed at 12:30 pm. The children were observed during free play (center) time, during outside time, and during lunch. There was discussion with the substitute teacher about both the regular teacher and substitute teacher's MAT certification expiring soon. Also, a fire inspection will be due in September.

Standard #: 22VAC40-185-60-A
Description: Based on interview with staff, the center failed to ensure that each child had a record at the center. Evidence: 1. Today was the first day attending for one child in care and there was no record available for the child. The regular teacher was absent on the date of the inspection and the substitute teacher stated that there was no record at the center for the child who started today.

Plan of Correction: The substitute teacher called the parent, family, and community engagement supervisor (PFCE) about the record. The PFCE stated that the child was not supposed to begin attending until later in the week. The PFCE brought the child's record during the inspection. In the future, the teacher will not allow the child to attend if the record is not at the site.

Standard #: 22VAC40-185-260-B
Description: Based on observation of posted inspections, the center failed to ensure that there was annual approval from the health department. Evidence: 1. The last "Report of Environmental Sanitation Inspection" form from the health department was last completed 8/27/15.

Plan of Correction: According to the parent, family, community engagement manager, the teacher had called the health inspector on 8/11/16 and left a message and called again on 8/24/16. The teacher will call again this week to follow up to have the health inspector complete the form.

Standard #: 22VAC40-185-380-A
Description: Based on observation and interview, the center failed to ensure that there was a posted daily schedule. Evidence: 1. There was no daily scheduled observed in the classroom. The substitute teacher was asked if there was a daily schedule and stated that there was not one.

Plan of Correction: The schedule will be posted when the regular teacher returns and will remain posted through the school year.

Standard #: 22VAC40-80-120-E-2
Description: Based on observation, the center failed to ensure that the findings from the most recent inspection of the facility were posted. Evidence: 1. There were four violations from the last inspection dated February 11, 2016. The "Violation Notice" was not posted from this inspection. The "Inspection Summary" showing that there were violations was posted but the actual findings on the "Violation Notice" were not posted.

Plan of Correction: The substitute teacher will post the "Violation Notice" from this inspection. The teacher will ensure this remains posted until the next inspection.
