22VAC40-191 Background Checks (22VAC40-191)

Technical Assistance:
We discussed the requirements for staff records and updated background checks. The risk assessments for violations were provided.

We talked about the schedule for outdoor time for both infant groups. A floater or third staff person may be needed to assist with outside time for the younger infants.

We talked about the removed tiles at the playground entrance in the resource room. Please let me know about plans for the floor maintenance.

You were reminded of the need to conduct a minimum of two shelter-in-place drills each year.

Thank you for your assistance during today's unannounced monitoring inspection conducted from 11:20 AM to 4:30 PM. Today, there were seventy-five children, ages infancy through four years, with seventeen staff. I viewed program activities, daily routines, staffing, supervision, interactions with children, lunch/snack, posted information, sign-in/out procedures, diapering procedures, infant care and records, diaper ointment, sunscreen storage, asbestos management, agency inspection reports, injury reports, emergency supplies and drill records, six staff records, staff qualifications, staff training, five records for children, indoor and outdoor areas. Also, I viewed the new deck area at the end of the playground and new equipment. The teachers were observed providing group activities and stories. The caregivers in the infant areas were attentive to individual needs for feeding, comfort and attention. A variety of age appropriate toys and materials were accessible for each age group. Description: Based on a review of six records for staff, and an interview with administrative staff, the updated TB screening and statement was obtained late and not by two years since the date of the last statement for staff member 4. Evidence: The TB statement with the date September 28, 2014 was not updated until August 9, 2016.

Plan of Correction: The director will resume using a reminder system for monthly checks of the staff record dates so that arrangements are made in advance of due dates for updated TB screenings and statements. The staff will be instructed to obtain updated TB screenings and statements before two years from the dates of the last statement.

Standard #: 22VAC40-185-70-A
Description: Based on a review of six records for staff, and an interview with administrative staff, there was not any documentation of the orientation training for staff member 1. Evidence: There was not an orientation checklist form in the staff record with the date of employment written as September 6, 2016. An administrative staff person indicated that training was done when the staff member started work and the form for orientation was not completed.

Plan of Correction: The director will place documentation of the orientation training in the file for staff member 1. As new staff members are trained, the orientation checklist will be kept accessible so that the training is documented as it is completed and the information is maintained in the staff file.

Standard #: 22VAC40-191-40-D-1-C
Description: Based on a review of six records for staff, and an interview with administrative staff, the sworn statement or affirmation and background checks were not updated before three years for staff member 4. Evidence: The most recent sworn statement or affirmation viewed in the file was from July 3, 2014. The last criminal record history was obtained on July 12, 2013. The last central registry clearance was obtained on July 31, 2013. An administrative staff person indicated that the requests for updated background checks had not been sent to Richmond.

Plan of Correction: The director will have staff member 4 complete a sworn statement and view the completed information before it is filed. The director will arrange to send the request forms for the criminal history and the central registry check to the agencies in Richmond, VA. The director will make sure the updated background checks are obtained, viewed and placed in the file for staff member 4. The director will resume using a reminder system for tracking the need to update records in advance of due dates.
