22VAC40-191 Background Checks (22VAC40-191)

Licensing Inspector arrived at 10:15 and departed at 11:30 AM. At the time of the tour, there were 36 children (ages infant through preschool) in care with nine staff. Children were observed having circle time, playing outside and doing other activities. There was no medication being stored or administered on site. The sample size was four staff and four children's records. Violations were noted in the areas of administration and background checks. Responses to violations were received on site at the conclusion of the inspection.

Description: Based on a review of four children's records, it was determined that the facility did not ensure that additional immunizations were received every six months for children under the age of two years. Evidence: The most recent immunizations available for child #2 (date of birth 3/11/15), who was in care at the time of the inspection was dated 3/18/16. Additional immunizations should have been obtained in September of 2016.

Plan of Correction: Parent was notified during the inspection and will provide updated immunizations at pick-up this afternoon.

Standard #: 63.2-1720-F
Description: Based on review of four staff records, it was determined that the facility did not ensure no employee is permitted to work in a position that involves direct contact with a child receiving services until an original criminal record clearance or original criminal history record has been received, unless such person works under the direct supervision of another employee for whom a background check has been completed. Evidence: Staff #3, date of hire 9/30/16, was observed working alone with a group of children. There was no completed criminal record check available for this staff member and she was not under the direct supervision of a staff member with a completed criminal record check.

Plan of Correction: Facility management will ensure that staff #3 is under the direct supervision of a staff member with a completed criminal history record.
