22VAC40-191 Background Checks (22VAC40-191)
An unannounced monitoring inspection was conducted from 11:30 a.m. to 1:50 p.m. At the time of entrance the following adult to child ratios were observed: 12 children, ages 2 to 4 years old, with 1 staff 5 infants and toddlers, ages 9 to 17 months old, with 1 staff The records sample size consisted of 4 children?s records and 3 staff records. Children were observed singing and dancing to music, washing hands and resting quietly on cots during nap period. Infants and toddlers were sleeping on mats and in cribs. Medication administration was not observed today. Transportation was not observed. However, the vehicle and required documents and supplies were viewed and standards pertaining to transporting children were reviewed. The administrator states that only school aged children are transported in a vehicle at this time. Repeat violations were found and are identified within this report. Areas of non-compliance are identified on the violation notice. Thank you for your time during today's inspection. Please do not hesitate to contact me if I may be of assistance. Upon receipt of the inspection documentation, the licensee must develop a plan of correction for each violation. The plan of correction must include the following: ? The steps to correct noncompliance with the standard(s); ? Measures to prevent reoccurrence of noncompliance; ? Person(s) responsible for implementation and monitoring of preventive measure(s); ? Date by which noncompliance will be corrected. The licensee will have FIVE calendar days from receipt of the inspection documentation to complete the section titled Plan of Correction, sign each page of the documentation and return it to the Licensing Office.
Standard #: 22VAC40-185-280-B Description: Based on observation, the licensee did not ensure that hazardous substances such as cleaning materials, are kept in a locked place using a safe locking method that prevents access by children. Evidence: The licensing inspector observed a closed gallon bottle of Clorox Bleach sitting on an open counter top next to the kitchen sink at a height of 3 feet. The bottled was labeled "Keep out of reach of children" and contained additional warnings to include "ICall poison control if ingested." The licensing inspector observed a small closed bottle of "Goo Gone" on a high shelf above the kitchen sink at a height of about 6 feet. The bottled was labeled "Keep out of reach of children" and contained additional warnings to include "If swallowed, call a physician immediately. Do not induce vomiting." The kitchen was adjacent to the area where children, ages 2 to 4 years old, were napping. The kitchen was open with no door separating the area at the time. Plan of Correction: The following written response was received in the licensing office on December 12, 2016: "The Clorox and Goo Gone were removed and secured immediately in a locked place. Kitchen staff was retrained on standard 22VAC40-185-(4)-280 B".
Standard #: 22VAC40-185-350-E-1 Description: Based on observation and interview, the licensee did not ensure that there was one staff member in ratio for every four children from the age of birth to 16 months old. Evidence: At 11:40 a.m. the licensing inspector observed 5 infants, ages 9 months, 10 months, 13 months 13 months and 17 months sleeping on mats and in cribs with one staff member in the infant classroom. When asked if another staff is normally present to assist, staff member # 4 stated that there are normally 2 staff, but that the other infant teacher had to leave when staff #4 arrived at 10:00 a.m. When asked if a second staff was assisting the staff previously caring for the infants prior to staff #4's arrival, staff #4 stated that there was only one staff there when she arrived due to another staff calling out that day. At 11:45 an additional staff (staff #3) arrived and went to the 2 to 4 year old group allowing staff #1 to come into the infant classroom to assist. Plan of Correction: The following written response was received in the licensing office on December 12, 2016: "There was a staff person late arriving to work and another staff person called out which resulted in the coverage being off until the late arriving staff arrived. All ratios were achieved."
Standard #: 22VAC40-185-350-E-2 Description: Based on observation and interview, the licensee did not ensure that there was one staff member in ratio for every children from the age of 2 years to old. Evidence: At 11:30 a.m. the licensing inspector observed 12 children, ages 2 to 4 years old, with one staff member in the preschool room. The children transitioned to washing hands and getting settled on rest mats for nap period by 11:45 a.m. When asked if another staff is normally present to assist, staff member # 1 stated that staff #2, who was cleaning tables from lunch, had been assisting her in caring for the children up through lunch time. Staff #1 stated that a third staff should have already arrived to assist but was running late. Staff #3 arrived at 11:45 a.m. and began assisting with the children. Plan of Correction: The following written response was received in the licensing office on December 12, 2016: "One staff person called out and the other arrived late causing the ratio issue. After the staff arrived to work all ratios were corrected".
