22VAC40-191 Background Checks (22VAC40-191)

An unannounced renewal inspection was conducted from 10:30 a.m. - 3:20 p.m. There were sixteen children in care with two teachers working directly with them. There were other school personnel available to assist as needed. Four children's records were reviewed. Three records for staff were reviewed. The children upon arrival were outside playing. They were also observed learning about the artist Joan Miro, carefully using their paint brushes applying colors to the self portraits they had molded in air dry clay, listening to Vivaldi while they were painting, during free play building with blocks, looking at books, playing pretend, engaged in discussions with one another and their teachers, laughing and playing, washing their hands and during pick-up by parents. Standard #: 22VAC40-185-160-C
Description: Based on record review the facility failed to have an updated tuberculosis screening for one staff person prior to two years from the last tuberculosis screening or test.


1. On 03/03/2017 the record for staff #1 was reviewed. The last documented tuberculosis screening/test for staff #1 was 10/21/20013.

2. On 03/03/2017 staff #1 confirmed there had not been an updated tuberculosis screening/test.

Plan of Correction: Staff #1 will have the tuberculosis screening immediately for the record. The staff information sheet for updating required information will be reviewed every two months in order to keep this from happening again.

Standard #: 22VAC40-185-70-A
Description: Based on record review the facility failed to have updated background checks prior to before three years since the dates of the last sworn statement, most recent central registry finding and most recent criminal history record check for one staff person. Evidence: 1. On 03/03/2017 the licensing inspector reviewed the record for staff #1 the last background checks were done in 2012. 2. On 03/03/2017 staff #1 reviewed the record and confirmed the background checks had not been updated.

Plan of Correction: Staff #1 has filled out the documents and have taken them to be notarized this afternoon. We should have these back in a couple weeks depending on how long it takes for the agencies to process them. The need for background checks will be reviewed every two months.

Standard #: 22VAC40-191-40-D-1-A
Description: Based on interview the facility did not have three references and background checks for the four board officers.


1. Based on interview staff #2 advised the facility would have to get these documents for the four board members listed.

Plan of Correction: We will get these documents done as required as soon as possible.
