22VAC40-191 Background Checks (22VAC40-191)
- Technical Assistance:
Consultation provided on storage of hazardous cleaning agents, need to remove excessive portable play equipment on the younger playground, outside time for infants, timely submission and checking on status of background checks.
An unannounced monitoring inspection was conducted today with the owner and director. Fifty eight children were present with 8 staff providing supervision. The older children were napping during the walkthrough. One child had emergency medication on site. Five staff and six children's files were reviewed today. Monthly escape drills and documentation of injuries and accidents were reviewed as well. Arrival time: 12:50 pm Departure time: 4:30pm
Standard #: 22VAC40-185-330-B Description: Based on observation, it was determined that there was less than 6 inches of resilient surfacing under and around the fall zones of the outside play equipment. Evidence: On the older playground, there was less than an inch of mulch under two of the swings on the playground. On the younger playground, there was no mulch at the end of the portable slide. Plan of Correction: We will assign a schedule to rake daily and we will look into the option of playground mats for high impact areas.
Standard #: 22VAC40-185-440-N Description: Based on observation, it was determined that there were mobiles hanging over the cribs of infants who were over five months of age. Evidence: Mobiles were hanging over the cribs of child A who is 6 months of age, child B who is 8 months of age, children C and D who are 10 months of age. Plan of Correction: Mobiles were taken off the same day.
Standard #: 22VAC40-191-60-B Description: Based on a review of five staff files and a interview with the owner and director, it was determined that there were no sworn disclosure statements completed on staff prior to the first day of employment. Evidence: Staff A,B,C,D and E were hired on 2/17/17 and to date there were no signed sworn disclosure statements on files for these staff. Plan of Correction: Forms will be signed and filed today.
Standard #: 22VAC40-191-60-C-1 Description: Based on a review of five staff files and an interview with the owner and director, it was determined staff did not have a criminal history record report on file within 30 days of employment. Evidence: Staff A, B, C, D and E were hired on 2/17/17 and to date they do not have a criminal record reports on file. There was no documentation provided that the center checked on the status of these background checks within 4 work days of the 30th day. Plan of Correction: We will not allow staff to come back until background checks are back. We checked on status with VSP indicated that they are processing and they will contact us as soon as they are done. Center will keep on checks daily and document until they come back.
