Comments:
The licensing inspectors conducted an unannounced renewal inspection from 8:40am - 12:00pm. Upon arrival there were twenty two children in care ages 2 years - 5 years with two staff. Three additional preschool children arrived during the inspection. Four additional staff arrived during the inspection. The children were observed working puzzles, during circle time, coloring, at story time and during free play. Six staff, four board officers and five children's records were reviewed. Violations from the previous inspection were also reviewed and all had been corrected. Areas of non-compliance are identified on the violation notice. Standard #: 22VAC40-185-40-E
Description: Based on review of the license, the center failed to comply with the terms of their current license issued by the department. Evidence: 1. The inspector reviewed the terms of the center's current license. There is a stipulation on the center's current license that states, "Children under 2 1/2 years of age are only allowed in classroom #3 with the maximum capacity of 20." Upon arrival at the center at 8:40am, there were twenty two children in care in classroom #3. Two additional preschool children arrived shortly after 8:40am and were also in classroom #3.

Plan of Correction: Children under 2 1/2 years of age will always use classroom #3 and the maximum capacity of 20 will be maintained. Ratios will also be maintained for 2 year old children in care, one staff to eight children.

Standard #: 22VAC40-185-350-C
Description: Based on observation, the center failed to maintain staff-to-children ratios. Evidence: 1. Upon arrival at the center at 8:40am, the inspectors observed the children in care in classroom #3. There were twenty two children ages 2 years 1 month to 5 years in care in classroom #3 with two staff. Two additional preschoolers arrived shortly after 8:40am for a total of twenty four children in care with two staff. Ratios apply to the youngest child in care. Staff-to-children ratios for two-year old children is one staff to eight children. Another staff member arrived at 8:55am and the children were separated into three groups.

Plan of Correction: The director had called in sick this morning. A staff was contacted to come in to assist in the director's absence. In the future when a situation like this arises, changes will need to be made earlier to prevent a ratio violation.

Standard #: 22VAC40-191-40-D-1-C
Description: Based on record reviews, the center failed to obtain repeat background checks on board officers. Evidence: 1. The inspector reviewed four board officer's records. All four officer's background checks were over three years old. Board officer record #1 contained a sworn statement dated 04/01/2013, a central registry finding dated 04/18/2013 and a criminal history record check dated 03/11/2013. Board officer record #2 contained a sworn statement dated 04/02/2013, a central registry finding dated 04/18/2013 and a criminal history record check dated 02/09/2013. Board officer record #3 contained a sworn statement dated 04/02/2013, a central registry finding dated 04/18/2013 and a criminal history record check dated 02/11/2013. Board officer record #4 contained a sworn statement dated 04/01/2013, a central registry finding dated 04/18/2013 and a criminal history record check dated 02/09/2013.

Plan of Correction: The director thought that the board officer's background checks did not need to be repeated every three years unless they were new officers. The director contacted the board officers and provided background checks forms to be completed and returned. The director will contact the licensing office when the background checks are processed and returned.

Standard #: 22VAC40-191-60-C-2
Description: Based on record reviews, the center failed to obtain a background check on a staff within 30 days of employment. Evidence: 1. The inspector reviewed six staff's records. One of six records reviewed (staff record #1) did not contain a search of the central registry, staff's date of employment was 01/09/2017 and the staff is still employed.

Plan of Correction: The search of the central registry check was returned to the center requesting more information. The director filed the form thinking it was complete. The staff member will complete another request and the director will submit.
