63.2 Child Abuse and Neglect
An unannounced complaint investigation was initiated jointly with Loudoun County child protective services on 05/17/2017. Staff and child interviews conducted, a review of staff records, the center's video recording of 05/15/2017, incident reports and the center's policies and procedures was made in response to the allegations. The preponderance of evidence does support the allegations and the complaint has been determined valid. Please email me at email@example.com with any questions or clarifications needed.
Standard #: 22VAC40-185-40-E Complaint related: Yes Description: Based on review of the Center's video recording, interviews with staff and review of the Center's employee handbook, the Licensee failed to ensure that staff followed the Center's policies and procedures. Evidence: l. The Center?s policy on student discipline is to initially use techniques of re-direction. On May 15, 2017, Staff #1 immediately used physical force in response to a child not following directions. 2. The Center's policy on forbidden actions includes roughly handling a child. On May 15, 2017 Staff #1 used a forbidden action with Child #1, when this staff member forcibly grabbed and pulled Child #1 out from under the playground equipment. 3. The Center's policy on playground procedures requires that all staff supervising children in outdoor playtime will adhere to positioning in strategic locations, scanning play activities, and circulating among the children. On May 15, 2017 Staff #2 sat down against the fence located behind the playground equipment and did not circulate among the children. Plan of Correction: All staff re-training on the center's discipline, forbidden actions and playground procedures. This training is mandatory.
Standard #: 22VAC40-185-80-B Complaint related: Yes Description: Based on staff interviews and documentation review the Center failed to report two suspected incidents of child abuse. Evidence: 1. An email dated March 21, 2017 was sent from Child #1's parent to the Center's owner. The email stated that Child #1's parent had found a fingernail mark on Child #1's right top of shoulder area and that Child #1 stated that a teacher at the center had caused the mark. 2. A second email dated May 15, 2017 was sent from Child #1's parent to the Center's owner. The email stated that Child #1's parent found scratch marks on Child #1's back and that Child #1 told the parent the same teacher referenced in the March 21, 2017 email had caused the scratches. 3. When interviewing the Center's owner, the owner confirmed receiving both emails from Child #1's parent and acknowledged that both allegations of physical abuse were not reported in accordance with 63.2-1509 of the Code of Virginia. Plan of Correction: Loudoun County CPS will provide training on child abuse, neglect and exploitation and the requirements of a mandated reporter. This training is mandatory for all staff.
Standard #: 22VAC40-185-180-B Complaint related: Yes Description: Based on staff interviews and documentation review, staff failed to carry out their assigned responsiblities in accordance with the Center's required training. Evidence: Despite documentation of completed required training, Staff #1,2,3 and 4 stated that they did not receive training on recognizing child abuse and neglect, playground safety and the Center's own policy on discipline. Staff were unfamiliar with the responsibilities of a mandated reporter. Staff acknowledged their signatures on the training documentation. Plan of Correction: Mandatory training will be required for all staff regarding the center's own policy of recognizing child abuse and neglect, playground safety and the center's own policy on discipline. This training will occur on June 7th and will be in-serviced at monthly meetings.
Standard #: 22VAC40-185-340-A Complaint related: Yes Description: Based on review of the Center's video recording and interviews, staff failed to ensure the care, protection and guidance of a child.
On 05/15/2017 at approximately 5:10pm, the Center's video system recorded Staff #1 roughly handling Child #1 by forcibly grabbing and pulling the child out from under the Center's playground equipment.
Plan of Correction: Center plans to appeal this finding.
Standard #: 22VAC40-185-340-F Complaint related: Yes Description: Based on review of the Center's video recording system and staff interviews, children were not within actual sight supervision of staff. Evidence: On the Center's video recording of the playground on 05/15/2017 at approximately 5:08pm, children were riding bikes on the concrete section of the playground. Staff confirmed that the children were not within actual sight of staff for approximately 3 minutes. Staff #2 was sitting against the fence, behind the playground equipment which obstructed the view of the concrete area where the children were biking. Staff #4 had their back to the children that were biking for approximately 3 minutes while they were adjusting the radio. Plan of Correction: Staff will be re-trained on actual sight supervision for children in care.
Standard #: 22VAC40-185-410-1 Complaint related: Yes Description: Based on review of the Center's video recording on 05/15/2017, staff used a forbidden action with a child. Evidence: On 05/15/2017 at approximately 5:10pm, the Center's video recording system recorded Staff #1 forcibly grabbing Child #1, and forcibly dragging Child #1 out from under the playground equipment. Once Child #1 was out from under the playground equipment, Staff #1 was recorded forcibly pulling Child #1 up from the ground by the child's left arm. Plan of Correction: Center plans to appeal this violation.
