22VAC40-191 Background Checks (22VAC40-191)

The licensing inspector completed an inspection in response to a self-reported incident regarding supervision that occurred on 4/21/17. The Department was notified of the incident on 4/25/17. The inspector interviewed staff, made observations at the center, and reviewed documentation at the facility on 5/5/17 from approximately 11:40am until 1:30pm and on 5/24/17 from approximately 9:50am until 11:00am. Telephone interviews were conducted on 5/23/17 and 6/5/17. The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the self-reported incident is determined to be valid. Please complete the columns for ?description of action to be taken? and ?date to be corrected? for each violation cited on the violation notice, and then return a signed and dated copy to the licensing office within 5 business days of receipt. Standard #: 22VAC40-185-40-E
Description: Based on a review of the facility's transportation policies, the facility did not ensure that the center's activities and services were maintained in compliance with the center's own policies and procedures. EVIDENCE: The facility's transportation policy states that parents should bring their children to and from the van for pick up and drop off. Staff person #2 stated that most times when child#1 and his siblings were dropped off, they were not met at the van by an authorized individual. They were permitted to walk into their apartment unaccompanied by an adult.

Plan of Correction: The policy have been reviewed by all van drivers. We had training on the proper way to transport children to and from home. No child will be permitted to walk alone without an adult.

Standard #: 22VAC40-185-340-A
Description: Based on interviews and documentation at the facility, the facility did not ensure the care, protection and guidance of a child in care. EVIDENCE: On 4/21/2017, child #1, 4 years old, was driven home from the facility on the facility's van. Upon arrival, at approximately 5:48pm, after unsuccessful attempts to reach the child's mother, the van driver was instructed by staff person #2 to have a 12 year old enrolled child escort child #1 to the upstairs apartment. Staff #1 stated that she could see the child enter the apartment, through a window in the stairwell. Upon the return of the 12 year old escort, the van left. According to the child's mother, no one was at home when child#1 was dropped off and he was alone until she arrived within an hour. When interviewed by the inspector, staff person #2, who normally drives the route, stated that the parent usually does not come outside to meet the van. The door is always open and the child and his siblings regularly let themselves in to the home where an adult is waiting. On this date, however, child#1's siblings were not with him, there was no adult waiting in the home and the facility left the child alone without verifying that there was an authorized adult there to receive the child.

Plan of Correction: The facility will communicate to staff and parents/guardians, a plan for a safe, supervised drop off and pick up procedure. NBFD or other adult in the vehicle must assure that all children are received by a responsible person who is indicated on the child application or is authorized by the parent. If no adult is present children will be transported back to the day care and parents must arrange pick up.

Standard #: 22VAC40-191-60-B
Description: Based on a review of a staff person's record, the facility did not ensure that a staff person had a completed sworn statement prior to employment. EVIDENCE: On 5/5/17, the record of staff person #1, start date 10/11/16, did not contain a completed sworn statement.

Plan of Correction: Had a meeting with my assistant to assure all paperwork are in each employee files. Staff will complete sworn statement day 1 of employment.
