22VAC40-191 Background Checks (22VAC40-191)

An unannounced monitoring inspection was completed on 7/6/17. There were 32 children present in four groupings. Five children's records and four staff records were reviewed. No medications at the center. The inspector arrived at the center at 11:00 am and departed at 3:30 pm. The children were observed during free time in the classrooms, during outside time, during lunch, and during nap. There was discussion with the director about the following: empty plastic bags accessible to the children in care (in toddler classroom) that were on the floor and in cubbies - reference to the Family Day Home standards prohibiting empty plastic bags, times between meals on the classroom daily schedules being accurate to what is actually practiced, upcoming health inspection due (August 2017), getting a copy of the background regulations for child welfare agencies.

Standard #: 22VAC40-185-60-A
Description: Based on record review, the center failed to ensure that two of five children's records were complete with documentation of all required information. Evidence: 1.Child #1 was missing the following required information: the work phone number for the father. 2.Child #5 was missing the following required information: an address for one of two required emergency contacts for the child, chronic physical problems, pertinent developmental delays, special health accommodations, allergies, if any (the spaces for this information were all left blank).

Plan of Correction: The director will call the parents to get the information to document in the child's record. In the future, the administrative person who reviews the child record at enrollment will ensure that all spaces on the child registration form are complete.

Standard #: 22VAC40-185-70-A
Description: REPEAT VIOLATION Based on record review, the center failed to ensure that staff records contained documentation of all required information. Evidence: 1.The record of staff #1 did not have documentation of the education requirement for the job position. 2. There was no termination date in the record of staff #2 who had worked at the center previously and then returned. There were two hire dates documented but no date that the staff person left. 3.. The record of staff #4 did not have documentation of an emergency contact name, address, and phone number for the staff person.

Plan of Correction: The director documented the termination date and the emergency contact information in the staff files. Staff #1 provided documentation of education requirement for the job position during the inspection. In the future, the administration will review staff files to ensure they have all information documented completely.

Standard #: 22VAC40-185-560-F
Description: Based on observation, interviews, and record review, the center failed to ensure that center provided meals met the nutritional requirements of a recognized authority such as the Child and Adult Care Food Program of the United States Department of Agriculture (USDA). Evidence: 1. The meal provided for one child (two years old) did not include a meat or meat alternate component and did not include a bread component. According to the staff, there was direction from the parent that the child could only have fruits and vegetables. The child's record had a notation made by staff that the parent would provide the child's meals. According to staff and the director, the parent was not providing meals and the center was responsible for the meals and snacks for the child. The child had been enrolled since 6/13/17.

Plan of Correction: The director will talk with the parent of how to make this correction and ensure the child is provided all components for future.

Standard #: 22VAC40-191-60-C-1
Description: Based on record review, the center failed to ensure that there was a completed original criminal history record check within 30 days of employment for one of three newly hired staff. Evidence: 1. Staff #4 was hired 4/3/17 and observed working on the date of the inspection. There was no completed Criminal History Record Check (CRC) in the staff person's file. There was no documentation that the CRC was sent by the center to the VA State Police within seven calendar days of hire.

Plan of Correction: The center director contacted the VA State Police during the inspection. The representative with the VA State Police asked the center to fax the original form that was sent. This was done by the center. The center director will follow up with the VA State Police to get the results.
