22VAC40-191 Background Checks (22VAC40-191)

An unannounced monitoring inspection was conducted in the Center on July 31, 2017. As reported, 15 children are currently enrolled in the program. A sample of 4 records, 2 staff and 2 children's was reviewed. Documentation of the center's annual fire and health inspections was current. Documentation of the practiced emergency drills was reviewed. Staff have current first aid and CPR certifications. A discussion was held with the Licensee regarding the Center's medication policy. As stated by the Licensee, the center does not administer medication. Staff have not completed the required medication administration training (MAT). Clarification was provided regarding medications and the training requirements as defined by the Code of Virginia. Certification in first aid and CPR does not meet the training requirement but is required to take the course. Medication training shall be completed by staff if a child attending the program is prescribed an emergency medication and the parent requests that the medication be available in the Center for emergency use. The Center has requested to change the stated hours of operation from 7:15am to 5:15pm. Violations from the previous inspection were reviewed for compliance. Description: Based on review of staff records, the Center failed to ensure a background check was verified before 30 days of employment at the facility ends. Evidence: 1. Documentation of a verified Search of the Central Registry was not available for review in the record of staff 1, employment date was noted as September 01, 2015. The form was submitted and returned to the center on 10/08/15, the form indicated not processed, incomplete. The Center had not resubmitted the form for processing. This is a repeat violation. A verified VA State Police Criminal History Record check including the Sex Offender Check was verified for the staff member on 10/22/15.

Plan of Correction: A new form has been completed and notarized for the staff member. The form will be mailed on August 1, 2017 to the responsible agency for processing.
