22VAC40-191 Background Checks (22VAC40-191)

The licensing inspector conducted an unannounced monitoring inspection, at which play groups, outdoor time, story time, group time, pre and post lunch activities, lunch time, and rest time were observed. Children were observed; and staff and children files and other documentation were reviewed. Twenty-five (25) children, aged 16 months-4 years, were found to be in care with 5 staff, kitchen staff, and administrative staff. Previous violations were reviewed, and had been corrected. Standard #: 22VAC40-185-270-A
Description: Based on review of the outside play areas used by the children the facility failed to maintain compliance with this standard as required relating to maintenance. Evidence: On the school age play ground there were landscaping timbers that were surrounding the play ground that had begun to deteriorate and one area in the corner had protruding nails. This deterioration of the wood and protruding nails posses a hazard to the children.

Plan of Correction: The owner and maintenance supervisor will be made aware of the need to fix the area. A plan will be formed and immediate action will be taken to ensure corrective action and compliance.

Standard #: 22VAC40-185-330-B
Description: Based on review of the play areas used by the children the facility failed to maintain compliance with this standard as required relating to resilient surfacing and fall zones under and around the play equipment. Evidence: On all 3 play grounds the resilient surfacing depth does not meet the ASTM requirements as required. There is approximately 2-3 inches of surfacing currently. Six (6) inches is required to be under and around the play equipment with movable parts/climbing/sliding areas. Also there was not a 6 foot fall zone under and around the little tykes type of slides/climbers on the 2 smaller playgrounds as required. Fall zones of 6 feet must be around all equipment with movable parts/climbing/sliding areas.

Plan of Correction: A meeting with the owner, maintenance supervisor, and director will occur as soon as possible in order discuss a time line of obtaining resilient surfacing, a plan to add it to the areas, and a plan to make the fall zones compliant.

Standard #: 22VAC40-185-510-C
Description: Based on review of the medications the facility failed to maintain compliance with this standard as required relating to authorization to administer medication. Evidence: The epi-pen for Child B did not have a current authorization to administer from the parent or the physician as the one on file had expired as of 05/25/2017.

Plan of Correction: The parent was notified during the inspection of the need to obtain a new long term permission to administer form from the physician. The parent will provide parental authorization to administer immediately as it is good for 10 days.
