Standard #: 22VAC40-185-40-E Description: Based on records review and interviews, the center did not ensure it's activities and services were maintained in compliance with licensing standards, the center's own policies and procedures that are required by these standards. Evidence: Licensing Inspectors obtained a copy of the center's policy on discipline. This policy is part of the center's parent and staff handbook, which is reviewed by all staff upon hire. Staff # 3 and Staff # 4 were trained on the center's policies for discipline. Page # 24 of the handbook includes the positive guidance policy which clearly states that teachers must keep in perspective the different ages and stages when using actions to develop positive behaviors in children. On page 25, inappropriate discipline methods are listed. It is clearly stated in this section that any actions from the list are prohibited, and are inconsistent with the principles of positive guidance. Staff #4 used a prohibited method of discipline as stated in the handbook which is "shaking, jerking, squeezing or physically indicating disapproval" Plan of Correction: Not available online. Standard #: 22VAC40-185-70-A Description: Based on record review, documentation of written information to demonstrate that staff orientation training required by the job position, was not obtained. Evidence: No record of training or orientation was found in Staff # 3's personnel file, to show that Staff # 3 had obtained training on Child Abuse and Neglect. Staff # 3 stated that the orientation was conducted upon hire. Staff # 3's hire date was 11/30/2015. Plan of Correction: Staff # 3 stated that he will try to find a copy of the orientation and give to the center director to add to his file.
Standard #: 22VAC40-185-340-A Description: Based on staff interviews and review of staff documentation, staff supervising children did not ensure their care, protection, and guidance. Evidence: 1. During the investigation held on 10/03/2017 four staff members were interviewed. On 09/29/2017, Staff # 3 and Staff # 4 were in direct supervision of the children during outside play in the park. Staff # 3 and Staff # 4 stated that Child #1 was hitting Child #2. Staff # 4 stated that after verbally speaking to Child # 1 about the behavior, Child # 1 did not stop. Staff # 4 intervened, and in her effort to discipline the child, Staff # 4 grabbed the Child # 1 by the upper arm and pushed him aside. Staff # 4 stated that Child # 1 was facing her when she pushed him. 2. A mother that was present on the playground, approached Staff # 4 to express her concerns about the way Staff # 4 was handling the children. Staff # 4 stated that she told the concerned mother that she was correct and needs to do better with handling the children. 3. Staff #4 asked Staff #3 to remind her that "if you see me getting physical tell me" Plan of Correction: Not available online. Contact Inspector for more information.
Standard #: 63.2-1509-A Description: Based on preponderance of evidence and staff interviews, the center providing full-time/part-time child care for pay on a regularly planned basis; did not report suspected child abuse to Child Protective Services (CPS) immediately to the local department of the county or city wherein the child resides or wherein the abuse or neglect is believed to have occurred. Evidence: 1. On the day of the incident (9/29/17), Staff # 4 self-reported in a written statement to Staff # 2 that she "grabbed Child #1 by the upper arm and told him to stop and walk away from the situation. She then slightly pushed with her hand to guide the child away". Staff # 2 did not report the suspected abuse to CPS. 2. On the day of the incident (9/29/17), Staff # 2 informed Staff # 1 of the self reporting from Staff # 4. Staff # 1 did not report the incident to CPS. 3. It is clearly stated in the staff and parent handbook of the school that "any incidents of abuse and neglect must be reported as defined by mandated reporting laws".
