The licensing inspector conducted an unannounced complaint investigation on Tuesday, October 03, 2017 in response to a reported incident that the Department received on September 30, 2017. The inspector was on site at the center on October 03, 2017 from 10:10am to 10:53am. Interviews with staff were completed, and documentation was reviewed. The inspector completed additional interviews on October 4, 2017, October 11, 2017, October 19, 2017, and October 23, 2017. See the violation notice for more details. Standard #: 22VAC40-185-40-E Complaint related: Yes Description: Based on a review of documentation and staff interview, the center did not ensure that the operational responsibilities shall include compliance with the center's own policies and procedures. EVIDENCE: 1. The center's transportation policy that was updated 11/2016 states that before the center can permit staff to transport children the driver must maintain a valid driver's license for the type of vehicle and the state in which the School is located. 2. On 09/29/2017 Staff #1 received a citation for driving without a license. 3. On 10/11/2017 Staff #2 stated that Staff #1's license was being held by the Department of Motor Vehicles. 4. On 10/19/2017 Staff #3 stated that Staff #1 license became not valid based on some action that happened in April 2017. 5. The center's transportation policy that was updated 11/2016 states that before the center can permit staff to transport children the driver must "[h]ave no driving-related convictions or citations in the last three years". 6. According to the 02/06/2017 driver history record in Staff #1's record, Staff #1 was convicted of reckless driving-speeding excess of 80mph on 04/22/2015 and 05/06/2014. 7. On 10/03/2017 Staff #2 stated that Staff #1 has driven the van for two years. Plan of Correction: Administration has reviewed the school's transportation policy and reviewed the policy with all drivers. All driver files have been checked again to ensure there are no driving related convictions or citations in the last three years. We will increase the frequency of driving record checks to annually rather than every 3 years. Further more we will also set up a tracking system to ensure that driver records are obtained and reviewed by administration and the drivers on the required basis. It is the driver's responsibility to inform administration of any tickets or violations given between the time we run driving record checks. Staff #1 did not inform us of any violations cited, therefore employment of Staff #1 was terminated as soon as administration was informed on 10/04/2017.
Standard #: 22VAC40-185-340-A Complaint related: Yes Description: Based on interviews and a review of documentation, the center did not ensure that staff supervising children always ensured their care, protection, and guidance. EVIDENCE: 1. Based on interviews with law enforcement on 10/04/2017, two eyewitnesses saw Staff #1 "clearly run the red [traffic] light" on 09/30/2017 and crash into another vehicle in the intersection. 2. On 10/03/2017 Staff #2 and Staff #3 stated that there were two children on the bus that Staff #1 was driving on 09/30/2017. 3. According the the police report, the other vehicle involved in the accident overturned when it was struck by the bus. 4. According the the police report, a four year old passenger in the other vehicle sustained a serious injury and had to be transported by emergency medical services. 5. According the the police report, the driver of the bus sustained a minor injury. 6. On 09/29/2017, Staff #1 received two citations, one for disregarding a red light and another for driving without a license. 7. The most recent driver history record in Staff #1's record (dated 02/06/2017) documents that Staff #1 was convicted of reckless driving on 04/22/2015 and 05/06/2014. Plan of Correction: Staff #1 was terminated for not disclosing the truth following the accident, and for not informing administration of driving violations received after DMV driving records check in February of 2017. The transportation policy has been reviewed with all of the drivers.
