Comments:
The licensing inspector completed an unannounced inspection in response to a self-reported concern regarding background checks. The Department was notified on 11/29/17. On 12/8/2017, the licensing inspector was present at the facility from approximately 11:30am until 2:15pm. The inspector reviewed documentation. The preponderance of the evidence gathered during the inspection supports the concern; therefore, the self-reported concern is determined to be ?valid?. Standard #: 22VAC40-191-40-B
Description: Based on a review of documentation, the facility allowed a person with a disqualifying background, who has not been granted a waiver, to work in the facility. EVIDENCE: The record of staff person #1, employed from 2/6/17 to 11/22/17 , contained a criminal background check dated 3/25/17, that reports that the staff person was convicted of a crime (7/28/2008), that is listed as a barrier crime. This particular crime prohibits employment in childcare for at least 10 years from the date of the conviction.

Plan of Correction: We terminated the employee.
