The licensing inspector completed an inspection in response to a self-reported incident regarding forbidden actions, that occurred on 11/1/17. The Department was notified of the incident on 11/3/17. The inspector interviewed staff, made observations at the center, and reviewed documentation at the facility on 11/8/17 from approximately 1:30pm until 3:13pm. The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the self-reported incident is determined to be valid. Description: Based on interviews at the facility, the facility did not ensure that a staff person did not roughly handle a child in care. EVIDENCE: Witnesses interviewed stated that during a transition on 11/1/17, staff person #1 instructed the 3 year old class to sit on a wooden border on the playground. Child #1, 3 years old, replied "no" and kept standing. Staff person #1 yelled at the child, telling him to sit down again. Again the child said "no". Staff person #1 sat the child down and the child stood back up. According to witnesses, the staff person appeared visibly angry when the child would not follow his instructions. Staff person #1 then picked up child #1 by the arms and forcibly placed the child over the 4 foot playground fence into the playground area for toddlers. One witness stated that she could hear the child's feet hit the ground when he landed.

Plan of Correction: The reported staff member was terminated after an immediate internal investigation. The remaining staff will be retrained on positive child guidance and proper child handling. Staff will sign off upon completion off training.
