Comments:
The licensing inspector conducted an unannounced non-mandated inspection, on 11/2/17, in response to a facility-reported incident that was received by the licensing office on 10/18/17. Interviews were conducted with staff, the childs parent, and a video of the incident was reviewed. There were 3 violations cited relating to this incident. Violations:
Standard #: 22VAC40-185-350-A
Description: Based on review of video footage and discussions with staff the facility failed to maintain compliance with this standard as required relating to the ratio for the 2 year old class room. Evidence: Licensing reviewed the video footage from a facility-reported incident that occurred on the morning of 10/17/17. 1. During review of the video there was a period of 8 minutes when the assistant, staff #1, was left alone with 14 two year old children while the lead teacher, staff #2, took child #1 to the office. 2. The lead teacher, staff #2, left the room at 8:49am and did not re-enter the room until 8:57am. 3. Staff #1 was unable to gain control of the children for activities during this time. 4. The required ratio in that class is 1 staff to every 8 children. No other staff were observed entering the room, to provide ratio coverage, during those 8 minutes.

Plan of Correction: This Plan of Correction and the statements contained herein are not admissions and do not constitute an agreement with factual allegations/statements contained in Violation Notice 591597, or that the alleged facts constitute a deficiency. Subject to and without waiving the above stated objections to the Violation Notice, Honeytree has taken the following actions: * Staff #2 was counseled and in-serviced on this regulation on November 2, 2017, following the DSS inspection. * All classrooms now utilize walkie talkies to call for assistants.

Standard #: 22VAC40-185-400-B
Description: Based on review of video footage and discussions with staff the facility failed to ensure that behavior guidance was constructive and age appropriate for the 2 year old class room. Evidence: Licensing viewed video footage for the morning of 10/17/17. 1. During review of this footage the inspector observed staff #2 throw a toy, while yelling "stop that" towards a group of children who were misbehaving, out of camera view, near the entry door of the classroom. This occurred on the video at the 8:35am mark. 2. At the 8:14am mark staff #2 used her pointer finger to push child #1 on the forehead telling him to stop getting near the paint cup sitting on the floor and to move back. 3. Again at the 8:15am mark staff #2 placed her palm to push another child on the forehead telling him to get away from the cup and to move back. 4. At the 8:36am mark staff #2 yelled loudly at a group of children to "get out of the bathroom" from her seated position in the middle of the classroom. 5. Child #1 was placed in a time-out situation from 8:10am until 8:25am, which is not appropriate for the age of the child, who is 2 years old. Staff #2 originally placed child #1 in time out at 8:10am, while the child would not stay in the time out area staff #2 requested staff #1 get the child from rolling on the floor and to continue time out with her (staff #1). 6. These actions by staff were not constructive in redirection of unwanted child behavior. Staff #2 was sitting in the floor doing a one-on-one art project during the entirety of the observed video, and staff #1 was observed to be sitting in a chair for the majority of the video with a tablet trying to take pictures of the children for the centers daily tadpole application.

Subject to and without waiving the above stated objections to the Violation Notice, Honeytree has taken the following actions: * The video footage referenced in the violation notice was shown to Staff #2 on November 2. Staff #2 was counseled and in serviced on this regulation on November 2, 2017, following DSS inspection. * All employees will be instructed that taking photographs for tadpole application should be secondary to interaction with and supervision of the students.

Standard #: 22VAC40-185-410-1
Description: Based on review of video footage and discussions with staff the facility failed to ensure that forbidden action was not used when behavior guidance was provided to a 2 year old child. Evidence: Licensing observed video of a facility-reported incident that occurred on the morning of 10/17/17. 1. Staff #1 was observed in the video roughly handling child #1, a 2 year old child, who was later diagnosed by the physician with a nurse maid elbow and shoulder. 2. Staff #1 was observed pulling child #1 by the left hand/outstretched arm, from a lying down position on the floor, to a standing position and walked him to where she was sitting placing him in time-out between her knees on the floor at 8:11am. 3. Staff #1 is again observed pulling child #1 by the same outstretched arm/hand to pull him back into a sitting position between her knees numerous times from 8:12am-8:17am. 4. At 8:17am child #1 becomes audibly and visibly upset. 5. At 8:25am the child was once again pulled up to a standing position from a sitting position, by his left hand/outstretched arm, to stand in front of staff #1 for a discussion before being let out of time out. 6. The child continued to be audibly and visibly upset, not using his arm, not interacting or playing with others, not engaging in any activity except to sit in a chair for art involving his feet, until he was taken from the room by staff #2, by the same hand/arm, to the office at 8:49am. 7. Staff #1 was observed throughout the video pulling numerous children, in the class room, by their arms for relocation to other areas for behavior guidance.

Plan of Correction: This Plan of Correction and the statements contained herein are not admissions and do not constitute an agreement with factual allegations/statements contained in Violation Notice 591597, or that the alleged facts constitute a deficiency. Subject to and without waiving the above stated objections to the Violation Notice, Honeytree has taken the following actions: * The facility terminated Staff #1 on October 18, 2017, prior to the DSS inspection.
