22VAC40-185 STAFFING AND SUPERVISION.
An unannounced inspection was conducted on November 8, 2017, November 9, 2017 and completed on December 21, 2017 in regards to a self reported incident regarding supervision. A joint investigation was conducted with the local department of social services. Areas of noncompliance are identified on the Violation Notice. Standard #: 22VAC40-185-40-E Description: Based on information obtained during an inspection, it was determined the center did not ensure they followed their own policy regarding child supervision. Evidence: A review of the centers policy under the areas of "Policy for staff expectations" and "Guidelines for safety in youth programs staff" states "Perform regular head counts & safety checks throughout the program's hours of operation" and "Never leave a child alone or alone with another adult or counselor". The center staff did not follow the center's own policy of supervising children always. Child #1 was left alone and was not supervised by a center employee for 1 hour and 15 minutes on November 6, 2017. Plan of Correction: Youth Programs will continue to enforce our written policies and hold staff accountable for following them. Policy is currently reviewed twice a year and will continue to be reviewed with all staff. Corrective action for staff #1 and #2 has been taken.
Standard #: 22VAC40-185-340-A Description: Based on information obtained during an inspection on November 8, 2017 and November 9, 2017, it was determined that the licensee did not ensure that when they are supervising children they shall always ensure their care, protection and guidance. Evidence: 1. A review of a video recording made on November 6, 2017 confirmed a three year old child was left alone in the community center restroom on November 6, 2017, for one hour and 15 minutes (12:16 p.m. to 1:31 p.m.) 2. Child #1 was found in the restroom by a patron in the community center. The patron sought the assistance of a community center staff member. The community center staff member discovered the child standing in the restroom visibly upset at 1:31 p.m. Child #1 was immediately returned to their classroom by the community center staff. 3. The child care center staff (Staff #1 and Staff#2) was unaware that the child was left in the restroom. 4. Staff #1 and Staff #2 confirmed through interview that they were unaware that the child was missing. 5. The community center restroom is utilized by all patrons of the community center who may use meeting rooms, gymnasium, and exercise room. Child care center staff were not able to ensure the child?s safety during the period when the child was not supervised. Plan of Correction: Continual on-site training will be conducted with all center staff to ensure proper procedure of supervising children is being followed during bathroom breaks to include face counts of participants, pre and post bathroom checks and staff communication.
Standard #: 22VAC40-185-340-F Description: Based on information obtained during the inspection, it was determined that the licensee did not ensure that children under 10 years of age shall always be within actual sight and sound supervision of staff, except that staff need only be able to hear a child who is using the restroom. Evidence: During the inspection conducted on November 8, 2017 and November 9, 2017, a review of the video recording and interviews with multiple center indicated that Child #1 (three years old) was not within actual sight and sound supervision of a staff member on November 6, 2017 for one hour and 15 minutes when the child was discovered by a community center staff in the restroom. Plan of Correction: Continual on-site training will be conducted with all center staff to ensure proper procedure of keeping children in sight and sound or being able to hear a child who is using the restroom is being followed during bathroom breaks to include face counts or participants, pre and post bathroom checks and staff communication.
