22VAC40-185 STAFFING AND SUPERVISION.
12/08/2017 An unannounced monitoring inspection was begun today in response to a self reported incident. The investigation is ongoing at this time. 12/11/2017 An unannounced monitoring inspection was conducted in response to our office receiving an allegation of a violation of standards. Based upon a review of documentation and multiple staff interviews, the preponderance of evidence supports the allegation. See violation notice for non-compliances. Standard #: 22VAC40-185-180-B Description: Based on interview statements and record review, staff were not able to demonstrate knowledge of information provided during staff orientation. Evidence: Staff did not demonstrate the ability to carry out job responsibilities when a child was fed food that contained a documented and known allergen and did not follow the action plan. (Staff A, B) Plan of Correction: Staff A did not recognize the child had been fed an allergen on 11/21/17. Will be retrained when returns to work. All teachers will be retrained at the December faculty meeting.
Standard #: 22VAC40-185-340-A Description: Based on staff interviews and record review, staff did not ensure the care and protection of a child with a documented food allergy when the child was served food that contains a known allergen. Evidence: *Child #1 (age 19 months) has documented food allergies with action plans and documentation on file. The child was fed food that contained allergens (milk). The child was fed tomato soup (that contained milk) on 11/21/17. The child's parent had been provided the center's menu for review so that alternative food items could be provided. The parent requested specific items not be fed to the child, based upon the menu. *Child #1 had diarrhea after being fed food to which he was allergic. According to the allergy action plan available for review, medication (Benadryl) should have been administered to the child when the child experienced intestinal issues. No medication was administered to the child. Plan of Correction: Allergy food lists from Good Food Company have been posted in all classrooms. They had always been given to teachers when they are updated. Teacher training was provided to all staff on Allergy Management on 9/17/17. We will revisit this issue at our December staff meeting on 12/27/2017. Since Child #1 often has loose bowels we are working withthe family to identify other possible/suspected allergens. Teacher A thought child #1 could have tomato soup so she did not think about medication being administered- retraining at next staff meeting.
