Comments:
An investigation was initiated on 11/06/2017. On site inspections were conducted on 11/06/2017, 11/07/2017, 01/11/2018 in response to a self-reported incident alleging inappropriate behavior guidance which was received by the licensing office on 11/06/ 2017. Interviews were conducted and video footage was reviewed. Based upon the information gathered during the investigation, the allegation was determined to be valid. Violations in the areas of behavioral guidance related to this incident are detailed in the violation notice.

Violations:
Standard #: 22VAC40-185-400-B
Description: Based on interviews and observation, it was determined that a staff member did not provide behavioral guidance that was constructive in nature, age appropriate or intended to redirect Children to appropriate behavior.

Evidence:

1. On 11/06/2017 the owner of the facility contacted the inspector with a self reported incident that occurred on that day. The director of the facility provided the inspector a video recorded of the incident. Inspector viewed the video recorded of this incident. The inspector viewed the video of Child #1 sitting in a chair in the classroom. Staff #1 then suddenly grabbed and pulled the top back rest area of the chair sliding and moving the chair as Child #1 sat in it.. Staff #1 then swiftly picked up Child #1 out of the chair by the arms and chest area quickly removing Child#1 from the classroom.

a. During an interview Staff #1 advised that Child#1 began to disrupt the classroom prior to nap time. Staff #1 explained that she moved the chair that Child #1 was sitting in to get him to stand up. Staff #1 stated that she wanted to remove Child#1 from the class room. Staff #1 advised Child #1 began screaming. Staff # 1 then advised that she picked up Child #1 and removed him from the classroom to prevent further disruption of the classroom. Staff #1 stated that Child#1 was taken to the directors office.
