Discussed with center director the need to keep children in the programs they have been registered for, in addition to potentially hiring more staff to maintain ratios. Also discussed background checks.
The Licensing Inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on 1/25/18. The complaint was related to older children being allowed in the infant classroom, and children being moved specifically between the infants, toddlers and two's classroom, to maintain ratios and reduce staff hours. Interviews were conducted with staff relating to the allegations and records were reviewed. The information gathered during this investigation supports the allegations, so the complaint is determined to be valid. Non-complaint violations are also listed on the violation notice. Standard #: 22VAC40-185-130-B Complaint related: No Description: Based on record review, center did not obtain additional immunization records for children under the age of two, every six months. Evidence: 1. Child # 4's enrollment date was 1/19/16. 2. Child # 4's date of birth is 11/19/14. The date for the last shots that the child recieved was 5/25/15. 3. Updated shot records were not obtained by the center every six months until the child turned two years of age, which happened after the child was enrolled at the center. Plan of Correction: Updated records were received but not in the file. Staff will not remove original paperwork but instead make copies. Records were updated/ returned the same day.
Standard #: 22VAC40-185-140-A Complaint related: No Description: Based on record review, there was no documentation of a physical exam for children. Evidence: 1. Child # 4's record did not have any documentation that a physical exam was completed for the child. 2. Child # 4's enrollment date was 1/19/16. Plan of Correction: Parent returned the physical the next morning
Standard #: 22VAC40-185-350-F Complaint related: Yes Description: Based on observation, record review and staff interview center is assigning children to different age groups without written permission from parents and written assessment by the program director. Evidence: 1. During the inspection, CSRs were reviewed from random dates. 2. There were two children present from the toddler classroom . The toddler classroom was closed and was not in use. Staff # 1 from the toddler was working with the infant classroom. Staff # 1 stated that she has been her room has been closed for some time and the children from her class get bumped to the toddler room so she can be used to work in the infant classroom. 3. Child # 1 and Child # 3 from the toddler class were observed in the Two's classroom. 4. Staff # 3 was in the 2's classroom with 5 children. Out of the 5, two were Child # 1 and Child # 3 from the toddler room. Staff # 3 stated that some of her children had been bumped to the Preschool classroom to maintain numbers as she was the only one working in that classroom. 4. To maintain ratio, Child # 4, #5 and # 6 from the two's classroom were combined with the Preschool (3 years old) classroom. The three children were logged in the preschool CSR. Staff # 2 in the preschool classroom confirmed that the children from the 2's classroom had joined her class to maintain numbers in the 2's classroom. Staff # 2 stated that this happened on a regular basis. 4. On the CSR for 1/26/18 Child # 4 was logged into the 3's classroom at about 8:16 am and stayed there until approximately 2:30 pm. 5. On the CSR for 1/29/18, Child # 4 was logged out of the 2's classroom at 7:55am and was logged back in at 9:25 am. 6. On the CSR for 1/29/18, Child # 5 and Child #6 were logged out of the 2's classroom at 10:45 am and logged back in at 12:17pm. Child # 5 and # 6 were logged out of the 2's classroom at 5pm and logged back in at 6:04 pm. 7. There was no documentation found in Child# 2's and Child # 4's files to indicate that repetitive transitioning of the children has been allowed by the parents accompanied by the written assessment from the director and program leader for each of the children. Plan of Correction: Train staff on how to properly complete the CSR's- to be completed by 2/19/18. Child # 4, 5, 6 were three year olds. We will make sure we have proper transition letters on file.
Standard #: 22VAC40-185-370-5 Complaint related: Yes Description: Based on staff interview and record review, infants were not protected from older children. Evidence: 1. During the investigation, 4 staff members were interviewed. Staff stated that Child # 1 and Child # 2 go into the Infant classroom during the early hours of the day. Staff stated that management was combining numbers in the morning and in the afternoon because they are trying to reduce the number of hours worked. 2. Child # 1 is enrolled in the Toddler program. Child # 1's date of birth is 5/6/16. 3. Staff stated that Child # 1 spends a portion of the morning in the infant classroom. 4. Staff also stated that Child # 1 is an active child and has sat and stepped on an infant while the infants were having floor time. 5. Child # 2's date of birth is 3/10/16. Child # 2 is enrolled in the Toddler program. 6. Staff has stated that Child # 2 also spends time in the early morning hours to maintain numbers. 7. The Child Supervision Record (CSR) from 1/24/18 shows that Child # 2 was logged in at 3:45 PM. The name to face check box shows that Child # 2 was logged into the infant classroom between 4-5 PM. At the back of the CSR for 1/24/18, Child # 2 has been logged into the infant classroom at 3:32 PM. Plan of Correction: Staff will be retrained on the importance of arriving to work on time and not calling out and how that effects all the classrooms.
