22VAC40-191 Background Checks (22VAC40-191)

Technical Assistance:
Consultation was provided to the Owner/Licensee regarding background check requirements. Information was provided regarding fingerprinting, Fieldprint's procedures, facility code, appointment scheduling and location. Once national fingerprint checks are verified, background checks will be valid for 5 years.

An unannounced Renewal inspection was conducted in the Center on February 8, 2018. Sixteen children were present, the children were separated in two groups. The youngest group were on the main level and the pre-K group was in the basement of the center. Documentation of the center's annual fire and health inspections was current. Reminder: fire inspection due by 02/16/2018. Reportedly, medications are not in the center, center staff have not completed medication administration training (MAT). A discussion was held with the Licensee regarding the licensed age range. The Licensee may request to lower the age range in the future but will not change the age range at this renewal inspection. Please provide proof of documentation to this LI within 10 days to verify background checks have been completed or forms have been submitted to the appropriate agency for processing. Standard #: 22VAC40-185-140-A
Description: Based on a sample review of children's records, the center failed to ensure documentation of a physical examination by or under the direction of a physician was obtained for each child. Evidence: 1. One of five reviewed children's records (child #3) did not have documentation of a physical examination. 2. The reviewed record contained the physical examination of the child's sibling.

Plan of Correction: The parent will be notified and the center will obtain documentation of the current physical examination form for record retention.

Standard #: 22VAC40-185-150-B
Description: Based on a sample review of children's records, each child's immunization record was not signed by a physician, his designee, or an official of a local health department. Evidence: Immunization records reviewed in two of five children's records (child #4; child #5) were not signed by a physician, his designee, or an official of a local health department.

Plan of Correction: Parents will be contacted and requested to provide an immunization record which has been signed by the physician or his designee. Documentation will be retained in each child's record.

Standard #: 22VAC40-185-550-C
Description: Based on direct observations, the Center failed to post emergency evacuation and shelter-in-place procedures in a location conspicuous to staff and children on each floor of each building. Evidence: The written emergency procedures for evacuation and shelter-in-place were not posted in the center. The evacuation maps and emergency preparedness plan were posted in the center.

Plan of Correction: The written procedures will be posted on each floor with the maps.

Standard #: 22VAC40-191-40-D-1-C
Description: Based on a sample review of staff records, the Center failed to obtain an updated background check before three years since the most recent criminal history record check report was verified. Evidence: 1. Documentation (SP266) sex offender registry form dated 6/16/17 was reviewed in the records for staff #5 and staff #6. Documentation (SP230) Criminal record report was not available for review for staff 5 and 6. 2. Documentation of the updated search of central registry was not available for review for staff #6, reviewed documentation of the CPS search of central registry was dated 05/13/14. Staff reported that the record was taken to another employment site for review.

Plan of Correction: Appointments will be scheduled immediately to complete a national fingerprint background check. Documentation will be maintained on site in each staff's record. Current documentation of the search of the central registry will be filed on site in staff's record.
