22VAC40-191 Background Checks (22VAC40-191)

An investigation was initiated on 11/27/17 in response to a self reported incident regarding a child being found unsupervised outside the center on 11/22/17. Unannounced on-site inspections were conducted on 1/10/18 and 3/1/18 and interviews with staff and collaterals were conducted. Documentation related to the incident was also reviewed. The investigation was concluded on 3/5/18. Based on the information gathered during the investigation, the incident is found to be valid. Violations in the areas of administration and staffing and supervision are identified on the violation notice.

Standard #: 22VAC40-185-140-A
Description: Based on record review and interview, the center did not ensure that each child shall have a a physical examination before the child's attendance or within one month after attendance. Evidence: 1. The record for child #1 has no documentation of a physical examination. Child #1 has a date of enrollment of 11/20/17. 2. The center director confirmed that there was no documention of a physical examination in child #1's record.

Plan of Correction: The center responded with the following: Student attended center for 1 month and 3 days. Parent was requested several times for physical. Child will be unable to return until physical is received, even with language barrier. Child is currently out of the country.

Standard #: 22VAC40-185-340-A
Description: Based on information obtained during the investigation, it was determined that the center did not ensure that when staff are supervising children, they shall always ensure their care, protection and guidance. Evidence: 1. On 11/22/17, child #1, age 2, was found unattended on the sidewalk outside the front of the center at approximately 12:17pm. 2. The center is located approximately 200 feet from a four lane road with a speed limit of 45 miles per hour. 3. Child #1 was found outside unsupervised at a time when school buses were dropping children off at the center. 4. Staff #1 stated the incident occurred on child #1's second day of attendance at the center and that he has had a difficult time adjusting. Staff #1 stated the child tries to leave the classroom whenever the door is opened. 5. A Virginia Beach Public Schools bus driver and bus assistant stated they noticed child #1 standing alone on the sidewalk near the front of the center as they were pulling up to the center. 6. An outside contractor stated she was coming out of the center when a bus assistant for Virginia Beach Public Schools brought child #1 to her and said the child was outside by himself. The outside contractor stated the bus assistant handed the child to her. She then took child #1 inside the center and gave him to staff #2. 7. Staff #2 took child #1 back to his classroom and heard staff #3 state "Where is child #1?" as she was walking into the classroom. 8. Staff # 3 and staff #4 could not give an exact time frame for when child #1 left the classroom but stated that he was in the classroom during lunch and was last seen by staff #4 in the play area by the trucks and kitchen set. 9. Staff #5 stated child #1 was not outside when she walked into the center at 12:14pm and he was not in the classroom when she arrived.

Plan of Correction: The center responded with the following: All staff members were retrained on proper supervision. A barrier was installed in the front hallway (half gate) to ensure there's no possibility of a child getting to the exterior door so quickly. Ensure classroom doors are shut for any new student starts or potential wanderers.

Standard #: 22VAC40-185-340-F
Description: Based on information obtained during the investigation, it was determined that the center did not ensure that all children 10 years of age or younger shall be within sight and sound supervision of staff. Evidence: 1. On 11/22/17, staff #1 self-reported that child #1, age 2, had walked out of the center and was found alone on the sidewalk at the front of the center at approximately 12:17pm. 2. A Virginia Beach Public Schools bus driver and bus assistant confirmed that they found the child alone outside the front of the center with no staff present. 3. Staff #3 and #4 were not able to give an exact time of when child #1 was last seen in the classroom. Staff #3 and #4 stated he was present at lunch and was seen afterwards in the classroom. 4. Based on interviews with center staff and Virginia Beach Public Schools Transportation staff, it has been determined that child #1 was out of sight and sound supervision of center staff for approximately 3-5 minutes.

Plan of Correction: The center responded with the following: All staff members were re-trained on proper supervision. Ensure doors shut for potential wanderers or any new students.
