22VAC40-191 Background Checks (22VAC40-191)

Technical Assistance:
We discussed the requirements for TB statements, expired medication and M.A.T. certified staff. The risk assessments for violations were provided. Also, we reviewed the requirements for a battery-operated radio, background checks for staff, children's records and emergency drills.

Thank you for your assistance during today's unannounced monitoring inspection conducted from 11:00 AM to 4:15 PM. Today, there were eleven children, ages five through eleven years, with two to four staff. I viewed program activities, daily routines, equipment, posted information, staffing, supervision, interactions with children, meals/snack, injury reports, emergency supplies and drill records, emergency planning, five records for children, five staff records, staff training, agency inspection reports, indoor areas. The outdoor playground equipment was not inspected due to inclement weather. The children have enjoyed a variety of seasonal activities and choices for play in various interest areas of the room. Description: Based on a review of a review of five records for staff, and interviews with administrative staff, the center failed to obtain updated tuberculosis statements by two years from the dates of the last screenings for staff members 2 and 4. Evidence: The most recent tuberculosis statements in the records were completed on February 16, 2016 for staff member 2 and on March 10, 2016 for staff member 4. The staff indicated that the updated screenings have not been obtained and no reminders were provided.

Plan of Correction: Staff member 2 and 4 were spoken to the day of the inspection about obtaining and submitting updated TB screening results. The administrative staff assigned to track the dates of staff records will use a system for determining the updated information and remind staff of upcoming due dates so that records are updated on time.

Description: Based on observation of the staffing for children in care, a review of staff schedules and staff with the required medication training, there was a period of time during the morning of March 27, 2018 that child 5M for whom an emergency medication was prescribed was present and was not in the care of a staff member with current M.A.T. certification. Evidence: Staff member 4 had current M.A.T. certification and had an unplanned need to leave at 8:30 AM. The remaining staff and substitute teacher sent to assist did not have M.A.T. certification. There was not a staff member present who had a current M.A.T. certificate until 11:45 AM.

Plan of Correction: The administrative staff who arrange to provide a substitute staff person who has current M.A.T. certification to cover absences by the only staff person with M.A.T. whenever a child is present who has emergency medication at the clubhouse program. As needed, additional staff will attend a M.A.T. class to ensure adequate coverage during program hours.

Description: Based on a review of medication kept at the center for five children, and interviews with staff, the center failed to return outdated medication to parents or dispose of the medication in a safe manner for child 2M and 3M. Evidence: There was emergency medication in the locked container for child 2M that expired in January 2018. Staff indicated that child 2m had other medication sent home at the end of the summer program in 2017 when the child last attended. There was emergency medication in the locked container for child 3M with an expiration date of September 2016 and the center records had a withdrawal date from enrollment for child 3M as May 14, 2016.

Plan of Correction: An administrative staff person will take the outdated medication either to a local pharmacy or the local police department for disposal. The director will schedule regular times for checking the medication in the locked container and determine expiration dates and expired authorized use. When children withdraw from care, the parents will be notified to pick-up all applicable medication. The medication will be disposed of after fourteen days if it is not picked up by parents.
