22VAC40-185 STAFFING AND SUPERVISION.
Today an unannounced complaint investigation was conducted with Center Director regarding concerns about termination against policy/contract, behavior guidance, and videotaping a child. After carefully interviewing staff and reviewing Center's written parent handbook violations were cited pertaining to these concerns. Standard #: 22VAC40-185-400-B Complaint related: Yes Description: Based on observations and interview with staff, staff were observed not using appropriate behavior guidance constructive in nature to redirecting children to appropriate behavior and resolve conflict. Evidence: Licensing inspector observed staff in the before care program, raising their voices, "yelling across the room" at children, and using a tone that was not appropriate to redirecting children to resolving conflict. Plan of Correction: Center Director stated that training will be provided to all staff on positive guidance with children .
Standard #: 22VAC40-185-420-A Complaint related: Yes Description: Based on review of policies, and interview, Center did not provide termination policies in writing prior to child's first day of attending. Evidence: A complaint investigation was conducted regarding termination policy and procedures. A review of the Center's parent handbook, did not include the termination policy in writing, and discipline policy to include acceptable and unacceptable behaviors and measures. Plan of Correction: Center Director stated that a termination policy will be put in place and in writing prior to enrollment and will include behaviors that will and will not be tolerated.
Standard #: 22VAC40-185-420-B Complaint related: Yes Description: Based on review of records and interview with staff, staff failed to inform parent and document disciplinary steps taken in response to persistent behavioral problems. Evidence: A complaint investigation was conducted today to address ongoing behavior concerns for a child. Interview with Staff revealed that ongoing behavioral problems were identified however staff failed to provide documentation of the disciplinary steps taken in response. Staff failed to keep a daily behavior chart for two weeks, after meeting with parent. Center Policy states that "after a conference with the parents, a daily behavior chart will be kept for two week. Plan of Correction: Staff will document behaviors, meetings, and strategies that are put in place when ongoing behavior problems exist.
