22VAC40-185 STAFF QUALIFICATIONS AND TRAINING.
The licensing inspector for Malcolm Cole Child Care Center conducted an announced non-mandated inspection in response to a self reported incident that occurred in the center. Interviews were conducted relating to the allegation of inappropriate behavioral guidance. The information gathered during the investigation does support the allegation, so the allegation is determined to be "valid." Standard #: 22VAC40-185-400-B Description: Based on interviews, a staff member failed to provide behavioral guidance that is constructive in nature, age and state appropriate, and intended to redirect children to appropriate behavior and resolve conflict. Evidence: Based on interviews, a staff member failed to provide behavioral guidance that is constructive in nature, age and state appropriate, and intended to redirect children to appropriate behavior and resolve conflict. Evidence: 1. Per interview with collateral witness, on 4/17/18, staff 1 was observed through the glass door of the classroom grabbing child 1 (15 months of age) by the upper arm and "kind of jerked her". The witness stated the teacher proceeded to drag the child about four or five feet and toss her onto her rest mat. The witness stated the child's feet were not off the ground but her feet were being dragged. The teacher did not appear to be angry and the child was not hurt. The teacher apologized as soon as she saw that the witness saw the incident. 2. Staff 1 stated she was cleaning up after lunch and preparing the children for nap and the floor was wet. Child 1 was standing and she was afraid the child would fall. Staff 1 had the mop and a rag in one hand so she grabbed the child by her upper arm with her other hand. She stated she did not pick her up but "kind of drug her" and put her on the mat. Staff 1 stated she knows she ?did it wrong but was worried the child would fall.? Plan of Correction: The Center Director is meeting with each member of staff individually and reviewing all of the requirements of Rule 22VAC40-185-(6)-400-B and the Center's Guidelines for Positive Guidance. Each staff member will be required to sign off confirming that they understood these requirements and the confirmation will be put in the staff member's file. As part of the retraining it is made clear that these expectations must be met at all times and that any failure to appropriately follow the Guidelines to redirect and guide the children in their care would result in discipline under the Center's progressive discipline policy, up to and including termination of employment. To assure compliance the Director and Assistant Director will perform regular formal and informal observations and provide feedback in all programs to ensure the Guidelines are being properly observed. For new staff, the Center's new employee orientation includes review of Positive Guidance Policy. Employee is required to sign off stating understanding and compliance. Re-training on Positive Guidance is conducted annually. Positive Guidance is reviewed individually during employee review process.
