22VAC40-185 STAFFING AND SUPERVISION.
63.2 Licensure and Registration Procedures
On March 6 2018 a self-reported incident regarding alleged inappropriate staff child interactions was received. An investigation was initiated on the same day. Interviews were conducted on site and by telephone with one parent, one police officer and seven staff currently and formerly employed at the center. Additionally, video footage was provided and reviewed. The investigation concluded on April 16, 2018. During the investigation there was insufficient evidence to support the reported allegation therefore this was deemed not valid. However, the investigation revealed other incidents involving inappropriate staff child interactions this information identified violations in the following areas of standards; operational responsibility, supervision, behavior guidance, forbidden actions, ratio, background checks. These violations were reviewed with the program director during the exit interview.
Standard #: 22VAC40-185-340-A Description: Based on video tape and interview the center failed to demonstrate that when staff are supervising children they will always ensure their care and protection. Evidence: 1 ? A 14 minute and 56 second video obtained from the facility administration shows no less than four separate inappropriate actions of a staff 1 on children placed in her care. However, staff 2, who was present during three of these actions, did not intervene on behalf the children. 2 ? Staff 4 reported knowing that staff leave the two year old classroom to talk to other people not in the two year old classroom. Staff 4 stated that staff 1 and 2 could not supervise children when they are talking to staff in other classrooms. 3 ? Seven out of seven staff interviewed stated that they had concerns at different times regarding the way in which staff 1 interacted and spoke to children in care. When asked to describe the tone of voice used by staff 1, the words ?rough, unkind, mean and not warm and fuzzy? were stated. One staff stated ?if I was a parent and heard that I would be mad.? Plan of Correction: All center staff will attend training on mandated reporting, direct supervision, classroom management and positive guidance by 5/18/18. Training will be conducted by an approved outside trainer. Staff 1 was removed from the classroom and separated on 2/27/18. Staff 2 was coached separately. The hotline number and local Virginia Beach County CPS number is posted in a location easily visible to all staff. Management will ensure compliance through regular room observations. Observations will be kept on file. DM will review observations during routine school visits.
Standard #: 22VAC40-185-340-F Description: Based on video tape review and interview the center failed to ensure that children under the age of 10 years are always within actual sight and sound supervision of staff. Evidence: In the two year old classroom there were 14 children present with two staff. 1 ? At minute marker 13:37 the video tapes shows that there are not any staff in the two year old classroom. Therefore there was not any actual sight and sound supervision. a. At minute marker 11:42 staff 1 walks out of the classroom. At minute marker 13:37 staff 2 walks out of the classroom. a. The video tape does not show either staff returning to the classroom until minute marker 14:01 when staff 1 returns to the classroom. 2 ? Staff 4 stated that when staff walk out of view of camera at the front of the two year old room they do so to talk to people in the classroom next door. Plan of Correction: The center will install two convex mirrors in the two-year old classroom on or before 6/30/18 to ensure that all areas of the room are visible to staff from all areas of the room. All center staff will attend training on mandated reporting, direct supervision, classroom management and positive guidance by 5/18/18. Training will be conducted by an approved outside trainer. Staff 1 was removed from the classroom and separated on 2/27/18. Staff 2 was coached separately. Management will ensure compliance through regular room observations. DM will monitor compliance with regulations during routine school visits.
Standard #: 22VAC40-185-350-E-3 Description: Based on video tape review and interview the center failed to ensure that for two-year-old children there is one staff member for every eight children. Evidence: In the two year old classroom there were 14 children present with two staff. 1 ? At time marker 36 seconds there are 14 children in the two year old classroom with one staff person. a. Staff 1 is seen on video tape leaving the room at 36 seconds. Staff one is seen returning to the classroom at one minute and 56 seconds. Therefore, the room was out of ratio for one minute and 20 seconds. 2 ? At minute marker 11:42 staff again leaves the classroom. There are 14 children present. a. Then at 13:37 staff 2 walks out of the classroom leaving 14 children alone and unsupervised. Plan of Correction: A review of staff to child ratio regulations will be conducted with all staff by an approved outside trainer by 5/18/18. Staff 1 was removed from the classroom and separated on 2/27/18. Staff are required to log ratio checks multiple times throughout the day. School management are required to verify ratio multiple times throughout the day. Staff will be required to notify management immediately of any potential staff to child ratio concerns. DM will check ratio on all school visits and will routinely check live ratios electronically through the school?s POS systems.
Standard #: 22VAC40-185-400-A Description: Based on video tape review and interview the center failed to ensure that behavioral guidance is constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts. Evidence: 1 - The video footage from minute marker 5:54 through 6:15 shows staff 1 sitting at a table in the two year old room with child 4. Staff 1 has provided child 4 an ?alternate snack? that she purchased because he did not want the snack that had been provided by the center. She and child 4 are eating the snack she provided. Child 1 walks over to the table and picks up an item from the table. Staff 1 snatches the item out the hand of child 1. A few seconds later child 1 reaches for another item. Staff 1 snatches the item out of the child?s hand and waves her hand in front of child 1 to move him away from the table. Child 1 briefly turns away from the table then turns back toward the table and walks around child 5 toward staff 1. 2 ? At minute marker 9:50 child 3 finds a clipboard used by staff for tracking face-to-name of children in care. Child 3 begins scribbling on the clipboard. At minute marker 10:00 staff 1 sees child 3 scribbling on clipboard and pulls the pencil out of the hand of child 3 with a grabbing/twisting motion. Staff 1 then reaches for child 1 with a quick pushing motion. Child 1 stumbles back one step then places his hand over his ears. Staff 1 uses a quick jerking motion to pick up the clipboard. She takes three steps in opposite direction of child 3 and throws the clipboard on a counter top. Child 3 is watching staff 1 as she walks away. Plan of Correction: All center staff will attend training on mandated reporting, direct supervision, classroom management and positive guidance by 5/18/18. Training will be conducted by an approved outside trainer. Staff 1 was removed from the classroom and separated on 2/27/18. Staff will complete training on My Path by 5/18/18 and utilize plans and/or strategies as applicable. MyPath is the company?s new behavior guidance resource for staff. Management will regularly observe classrooms to ensure programming is age and stage appropriate at all times. DM will monitor compliance with regulations during routine school visits.
Standard #: 22VAC40-185-410-1 Description: Based on review of video footage the center failed to ensure that the following actions are forbidden: physical punishment or roughly handling a child. Evidence: The following incidents were observed on video footage provided by the center. 1 ? At minute marker 6:13 as child 1 is approaching staff 1, staff 1 pushes child 1 with enough force to knock him off his beet causing him to land on his bottom on the floor. 2 - Video footage shows child 3 playing at the sink in the classroom for 7 minutes and 36 seconds. At which point staff 1 pulls child 3 away from the sink, lifts him up under both arms off the floor and swings her arms and his body to her left and puts child 3 on the floor with enough force that that child knees bend. Child 3 is off balance as staff 1 maintains one hand on child 3?s upper arm until he is able to regain his balance. This action is done while staff 1 has her back turned to child 3 who is now standing slightly behind and next to staff 1 with his hands over his ears. Child 3 maintains this position for 21 seconds. 3 ? At minute marker 10:30 child 2 pushed child 1. Staff 1 crosses the room and tosses a chair out of her path. Child 2 begins to run away from staff 1. Upon reaching child 2, staff 1 uses her left hand to push child 2 up against the nearest wall, while grabbing his left upper arm with her right hand. Staff 1 leans in close to the child the using her right hand in a quick swinging motions lifts the child up off the floor and sets him down again with enough force that child 1 stumbles over his feet, lands on the floor bottom first before getting up and running out of the classroom. a. Staff 2, who was sitting nearby stated that she heard and saw staff 1 as she pushed child 2 against the wall. b. Staff 2 stated that staff 1 said ?Do you want me to smash your head inside the ?F?? wall!? Plan of Correction: All center staff will attend training on mandated reporting, direct supervision, classroom management and positive guidance by 5/18/18. Training will be conducted by an approved outside trainer. Staff 1 was removed from the classroom and separated on 2/27/18. Management will ensure compliance through regular room observations. DM will monitor compliance with regulations during routine school visits.
