22VAC40-185 PROGRAMS.

Comments:
An investigation was conducted today following a self-reported concern from the facility. Records were reviewed, staffmembers were interviewed and staff were observed in the classroom. The following licensing standards were examined: 400 B: Behavioral guidance shall be constructive in nature, age and stage appropriate; and shall be intended to redirect children to appropriate behavior and resolve conflicts. 410-2: The following actions or threats are forbidden: enclosure in a confined chair that the child cannot freely exit himself. After review, the facility was found to be in violation of the two standards, and therefore the self-report is being deemed valid. A Violation Notice was issued, and it is of note that the center took immediate action to remedy the situation, as described in the Plan of Correction. Standard #: 22VAC40-185-400-B
Description: Based on interviews, record review and confirmation, behavioral guidance was not constructive in nature, age and stage appropriate as required in one classroom.. Evidence: Documentation and staff confirmation explained that Staff #1 reported that she was frustrated with a child who was biting in the classroom.. When Child #1, age two, did not respond to redirection, she placed him in time -out in a chair designed for toddler-aged children. Additionally, the child remained in a time out situation for an estimated time of 5 - 8 minutes.

Plan of Correction: Staff #1 was terminated 4/20/18.

Standard #: 22VAC40-185-410-2
Description: Based on interviews, confirmation and record review, enclosure was used as a means of restricting a child's movements in one classroom with one child. Evidence: Staff # 1 reported that, in order to maintain behavior following a biting incident, a floor chair with a safety belt was brought from the toddler room into the two year-old room to keep Child # 1 contained. Staff # 2 reported that this occurred "a few times" and that the two year old was placed in the chair, "sometimes but not always" with the belt fastened.

Plan of Correction: Staff #1 was terminated as of 4/20/18.
