Comments:

An unannounced inspection was completed at the facility from approximately 9:00 am to 12 noon to investigate an allegation that the licensee was operating outside of the terms of the license issued. The licensee/administrator was on site. It is alleged that the facility has more than eight residents in care. The facility reported nine residents in care on the date of the inspection. Therefore, the allegation was determined to be valid.

Description:	Based on an inspection at the facility on 1/29/2020 by three licensing representatives, the licensee failed to ensure compliance with the terms of the license issued by the department. Evidence: 1. The Department received an allegation that the facility had more than eight individuals in care. The licensee confirmed eight individuals in care and identified by name the eight individuals ( # 1, # 2, # 3, # 4, # 5, # 6, # 7 and # 8). 2. A representative of the Veteran's Benefits Administration, who was on site at the time of the inspection, identified another individual in care (individual # 9). When licensing staff asked if individual # 9 was a resident of the facility, the licensee responded "No". The representative interrupted and said "he does live here, I saw him here last week". The licensee then responded "he is my relative, I can have relatives in the back". The representative stated "No, he is not a relative". The licensee then stated "I adopted him". 3. The three licensing staff interviewed individual # 9 at his day program on 1/29/2020. He confirmed that he lives on the first floor in the back portion of the facility. He reported that facility staff stores and administers his medications and prepares his meals, The license issued by the Virginia Department of Social Services authorizes the licensee to provide care to eight residents/individuals. The licensee identified nine residents/individuals in care on 1/29/2020.
Plan of Correction:	The facility has evicted the resident in questioning and has also given each resident a private room to assure DSS there will be the correct amount of residents in the future. There's currently no more semi private rooms.
