22VAC40-185 SPECIAL CARE PROVISIONS AND EMERGENCIES.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A complaint inspection was initiated on February 17, 2021 and concluded on February 18, 2021. A complaint was received by the department regarding allegations regarding procedures for emergencies. The director was contacted by telephone to conduct the investigation. Interviews were conducted and evidence was collected.

The evidence gathered during the investigation supported the allegations of non-compliance with standards or law and violations were issued. Any violations not related to the complaint but identified during the course of the investigation can be found on the violation notice.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring

Description: Based on a review of records and interviews on February 17, 2021 and February 18, 2021, the center did not maintain a written record of children's serious and minor injuries in which entries are made the day of occurrence and include date and time of notification to parents and method of notification.
Evidence: 1. On February 17, 2021, the department received evidence from an outside source of an injury report for Child #5 dated 2/10/21.
2. On February 17, 2021, Staff #1 and Staff #2 both stated they did not have any injury reports for the center for January and February.
3. On February 17, 2021, Staff #3 stated there have been no accidents or injuries in her classroom in the past two months and that she hasn't written any injury reports.
4. On February 17, 2021, after the owner was interviewed, administration at the center then stated they had injury reports for both months requested and sent them for review.
5. On February 17, 2021, injury reports from the center were reviewed. There was no documentation of the injury report for Child #5.
6. On February 18, 2021, when Staff #1 was asked about the missing injury report for Child #5, it was then reported that administration was aware of the injury. Staff #1 said that Staff #2 completed the report and that Staff #2 probably didn't make a copy of it. A copy of the missing report for Child #5 was requested to be sent by the center.
7. On February 18, 2021, the center sent a copy of the missing report for Child #5 dated 2/10/21. The incident was dated as 2/9/21. The injury report contained documentation of one staff signature on the report.
8. On February 18, 2021, Staff #1 stated that Staff #2 wrote the report because Staff #3 had to leave to take her son to the doctor.
9. On February 18, 2021, evidence was received from an outside source that the center requested that the source send the center a copy of the injury report for Child #5 because they didn't make a copy and needed it for their files.
10. On February 18, 2021, the injury report for Child #2 did not contain the date and time when parents were notified and how the parent was notified.

Plan of Correction: The Directors staff # 1 and staff # 2 make sure that the center maintains a
copy of children?s serious and minor injuries, in which entries are made the
day of occurrence and include date and time of notification to parents and
methods of notification.
The 2 Directors, staff #1 and # 2 were contacted by the licensing
inspector on 2/17/21. The directors understood that the licensing inspector
was requesting information about any ?serious injuries requiring medical
attention during the months of January and February 2021?. To the
knowledge of staff # 1 and # 2 and # 3 there had been no ?serious injuries?
requiring medical attention?.
To correct the possibility of mixed messages the center requests that
allegations be given to the center in writing by the licensing inspector so
that there can be no misunderstanding of what the inspector wants.
The owner talked to the licensing inspector and ascertained that she
was asking for ?minor incidents?. The owner clarified what information that
the licensing inspector was requesting.

2/17/21

Once clarified on 2/17/21, staff #1 & staff # 2 sent the minor incident
reports on file to the licensing inspector.

2/18/21

The next day on 2/18/21 the licensing inspector stated that she was
actually looking for an incident involving another child, now # 5.
Staff # 2 was late to work on 2/18/21 because of the Virginia Ice
Storm, so staff # 1 looked for the center?s copy of the missing incident
report for child # 5. Because the licensing inspector had set a firm deadline
of 2pm for the receipt of her request to produce the incident report, and
because staff # 1 could not immediately locate the centers copy, Staff # 1
asked the parent to give her the parents copy of the incident report so she
could comply with the licensing inspector?s deadline.

2/19/21
Staff # 2 located the centers copy of the incident report in her ?To file
box?, and it was signed by 2 staff members.
