63.2(17) License & Registration Procedures

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, document review and a virtual tour of the program.

A monitoring inspection was initiated on 11/16/2021 and concluded on 11/29/2021. The provider was contacted by telephone and a virtual inspection was conducted. There were no children in care and two staff members were present during the inspection. The inspector reviewed compliance in the areas of administration, staff qualifications and trainings, staffing and supervision, programs, emergencies and nutrition. A total of 2 children?s records and 2 staff records were reviewed.

New requirements became effective on October 13, 2021. The facility has not yet complied with the following requirement(s):
?8VAC20-780-40-K The center shall develop written procedures for prevention of shaken baby syndrome or abusive head trauma, including coping with crying babies, safe sleeping practices, and sudden infant death syndrome awareness.
?8VAC20-780-40-M The center shall maintain, in a way that is accessible to all staff who work with children, a current written list of all children's allergies, sensitivities, and dietary restrictions documented in the allergy plan required in 8VAC20-780-60 A 8. This list shall be dated and kept confidential in each room or area where children are present.
?8VAC20-780-80-A For each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs. The center shall develop written procedures for prevention of shaken baby syndrome or abusive head trauma, including coping with crying babies, safe sleeping practices, and sudden infant death syndrome awareness.

The facility is to review the new requirements and work with their assigned inspector to ensure future compliance

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.

Violations:
Standard #: 22VAC40-191-60-C-2
Description: Based on record review and discussion with staff, the center failed to obtain the findings of a search of the central registry within 30 days of employment.

Evidence: The record for Staff 2 contained a documented hire date of 06/21/2021. There were no central registry findings available for review during the 11/29/2021 inspection.

Plan of Correction: Will be part of the new hire paperwork and will follow-up if not received within 20 days.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review and discussion with staff, the center failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint background check as required by the Code of Virginia.

Evidence:
1. The record for Staff 1 contained a documented hire date of 07/20/2020. There was not an employment eligibility letter available for review during the 11/29/2021 inspection.
2. The record for Staff 2 contained a documented hire date of 06/21/2021; the employment eligibility letter was dated 10/12/2021.

Plan of Correction: Will become part of the application process and will be done prior to hire.
