22.1 EARLY CHILDHOOD CARE AND EDUCATION

Comments:
A renewal inspection was conducted on February 14, 2023. The inspector was on site from approximately 3:30 pm pm until 5:00 pm. The director was present and assisted with the inspection. There were 18 children present, ranging in ages from five years to ten years, with two staff supervising and one volunteer employed with the elementary school. Later eight additional children arrived from another elementary school. Children were observed decorating sugar cooking for valentine?s day, playing board games and completing homework. Later children went to the gym to play a group game. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of five child records were reviewed. Four staff records were reviewed on February 22, 2023.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.
Please complete the plan of correction and the date to be corrected for each violation listed on the violation notice and return it to the department within 5 business days from receipt. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s); 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on a review of four staff records, the center did not obtain the results of a search of the child abuse and neglect registry and an out of state criminal history name check from any state in which one staff member had resided in the preceding five years within the required time frame.

Evidence:

The record for Staff #3, employed 09/03/2020, indicated the staff had resided in another state outside of Virginia within the last five years.
1. The record contained the results of a search of the child abuse and neglect registry from that state dated 11/19/2020 along with documentation that the request for the child abuse and neglect check had been requested on 10/09/2020 exceeding the 30th day of employment. The out-of-state search for founded complaints of child abuse or neglect is required to be requested within the first 30 days of being employed.
2. The record contained the results of a criminal history search dated 11/18/2020 along with documentation that the search was requested on 11/30/2021 exceeding the first day of employment. Results of a criminal history check is required prior to the 1st day of employment.

Description: Based on revied of five children?s records, the center did not obtain documentation of a physical examination for one child?s record before the child?s attendance or within 30 days after the first day of attendance.

Evidence:

The record of child #1. Enrolled 08/22/2022, did not contain documentation of a physical examination exceeding 30 days from the first day of attendance.

Description: Based on review of five children?s records, the center did not obtain all required documentation for four children?s records.

Evidence:

1. The record of child #1 did not contain the name, address, and phone number for one emergency contact.
2. The record for child #3 did not contain the name, address, and phone number for two emergency contacts.
3. The record for child #4 did not contain the name, address, and phone number for two
Emergency contacts.

Standard #: 8VAC20-780-510-L
Description: Based on observation and interview, the center did not ensure medications were kept in a locked place using a safe locking method that prevents access by children.

Evidence:

1. Medication for child #2 was observed unlocked in a zip-lock bag. The zip-lock bag was being stored in a drawstring tote and was laying on the stage accessible to the children in care.
2. Two packets of fever reducing medication was observed unlocked in the first aid kit.

Description: Based on observation and interview, the center did not maintain one working, battery operated radio in each building used by children.

Evidence:

The batteries in the radio did not work. The director stated she did not have additional batteries on site.
