Technical Assistance:
Legislative changes effective July 1, 2020 reviewed with emphasis on new out-of-state background check requirements.

Resilient surfacing and fall zone requirements reviewed.

Written information has been provided for the above requirements.

Comments:
This inspection was conducted by licensing staff using an alternate protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was initiated on 12/14/2020 and concluded on 12/16/2020. The director was contacted by telephone to initiate the inspection. There were 17 children present and 4 staff. The inspector emailed the director a list of items required to complete the inspection. The inspector reviewed 3 staff records and 3 children's records submitted by the facility to ensure documentation was complete.

Information gathered during the inspection determined non-compliances with applicable standards and violations were documented on the violation notice issued to the facility.

The licensing inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care Programs.

Violations:
Standard #: 22VAC40-185-270-A
Description: Based on observation, the center failed to ensure that areas and equipment of the center shall be maintained in a safe condition.

Evidence:
1. A wall mounted flat screen television was observed in the toddler 1 classroom. The cord from this television dangled down the wall and was plugged into an electrical outlet located near the floor.
a. This cord was within reach of children and presents both an entanglement and toppling hazard.

Plan of Correction: This has been fixed.

Standard #: 22VAC40-185-330-B
Description: Based on observation, the center failed to ensure that where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials standard F1292-99 as shown in Figures 2 (Compressed Loose Fill Synthetic Materials Depth Chart) and 3 (Use Zones for Equipment) on pages 6-7 of the National Program for Playground Safety's "Selecting Playground Surface Materials: Selecting the Best Surface Material for Your Playground," February 2004, and shall be under equipment with moving parts or climbing apparatus to create a fall zone free of hazardous obstacles. Fall zones are defined as the area underneath and surrounding equipment that requires a resilient surface. A fall zone shall encompass sufficient area to include the child's trajectory in the event of a fall while the equipment is in use.

Evidence:
1. Two movable outdoor play structures lacked any resilient surfacing underneath and surrounding the structure.
a. One structure has a slide and climbing wall attached.
b. The second structure has a slide and climbing ladder attached.
2. Both climbing structures have been placed on top of an asphalt parking lot which is the surface of the outdoor play area.

Plan of Correction: A company has been contacted and resilient surfacing will be installed after the holiday.

Standard #: 22VAC40-185-560-G
Description: Based on observation and interview, the center failed to ensure that when food is brought from home, the food container shall be dated.

Evidence:
1. The lunch container viewed was not dated.
a. Administrative staff indicated that the lunch containers were not dated.

Plan of Correction: All lunch containers will be dated going forward.
