22.1 Early Childhood Care and Education

Technical Assistance:
Discussed reviewing the new CDC standards that became effective 10-13-2021 and the new website (Child Care VA) https://www.doe.virginia.gov/cc/.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a tour of the program.

A renewal inspection was initiated on February 9, 2022 and concluded on February 14, 2022. The director was contacted by telephone and on February 9, 2022 an in person inspection was conducted. There were 24 children present, ranging in ages from 5 to 11, with 3 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 3 child records and 3 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on review of 3 staff records and staff interviews, the licensee did not ensure the child day center obtained a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years. The child day center is to obtain complete data before reporting to the child day center.

Evidence: The record for staff #2, date of hire 9-2-2021 did not include the results of a sex offender check or child protective service (CPS) check for the state of New York, where they had lived within the last 5 years. The sex offender check results are dated 12-23-2021 and they were not conducted prior to employment as required. The CPS was requested on 2-10-2022, no results available for review and the request was not made by the end of the 30th day of employment as required.

Plan of Correction: Area Manger will ensure that all background checks are sent out prior to staffs first day to ensure they are returned in a timely manner.

Standard #: 8VAC20-780-160-A-1
Description: Based on record review of 3 staff records and staff interviews, the licensee did not ensure documentation of the tuberculosis (TB) screening was submitted at the time of employment and prior to coming into contact with children.

Evidence; The record for staff #1, has TB results dated 2-3-2022 which after they came in contact with children on 1-31-2022. This is verified by center staff.

Plan of Correction: On boarding staff will be required to submit TB results/ TB screening prior to first day with children.

Standard #: 8VAC20-780-550-D
Description: Based on documentation review and staff interviews, the licensee did not ensure to implement a monthly practice evacuation drill.

Evidence; There was not documentation of a monthly practice drill conducted in December 2021.

Plan of Correction: Program manager will ensure monthly drills are completed and documented on the proper forms.
