Technical Assistance:
Technical Assistance given and licensing standards were reviewed regarding toy recalls, physical plant, TB screenings, and sworn statements.

Comments:
An unannounced monitoring inspection was conducted on September 21, 2023, from 10:20am to approximately 1:30pm. There were 39 children and 9 staff members present. The Inspector reviewed five children?s records and nine staff records. The Inspector observed the interaction of staff and children throughout the inspection. Children were observed during group activity, free play indoor and outdoor, handwashing, diapering, lunch and nap. First aid kits and emergency preparedness documents and supplies were observed. Currently the facility does not have medications. The transportation vehicle for children before and after school was observed. Information regard children?s allergies and children?s injuries were also discussed during the inspection. Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the program. The violations were discussed at the exit interview with the center director, assistant director, and owner.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, it was determined that the center did not ensure that they obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
Evidence:
1. Staff #3 (date of hire 08/28/2023) reported that they lived in another state outside of Virginia in the past five years. In addition, their resume states they worked in another state outside of Virginia. Staff #3 has a copy of an identification card that was issued by another state in the past five year. No out of state background check results were completed for Staff #3.
2. Staff #4 (date of hire 08/30/2023) confirmed to the center that they lived in another state outside of Virginia in the past five years and no out of state background check results were completed for Staff #4.
3. Staff #5 (date of hire 9/11/2023) confirmed on their sworn statement disclosure that they lived outside the state of Virginia in the past five years and did not have an out of state background check result in their record. Staff #5 just recently moved from out of state to Virginia.
4. Staff #6 (date of hire 08/01/2023) has a copy of their identification card that was issued to them in the past five years from another state outside of Virginia. Staff #6 confirmed to the center that they lived outside of Virginia in the past five years and did not complete an out of state background check.
5. Staff #1 confirmed that out of state background checks were not completed for Staff #3 Staff #4, Staff #5 and Staff #6.
The center responded with the following: The out of state background checks for Staff #3 Staff #4, Staff #5 and Staff #6 will be completed and sent to the licensing office within 10 business days.

Plan of Correction: The center responded with the following: The out of state background checks for Staff #3 Staff #4, staff #5 and Staff #6 will be completed and sent to the licensing office within 10 business days.

Standard #: 8VAC20-780-270-A
Description: Based on observation and interview, it was determined that the center did not ensure that areas and equipment of the center, inside and outside, shall be maintained in a safe and operable condition.
Evidence:
1. In the playground, there is a large storage bin that is unlocked and the lid is broken. This poses as an entrapment and injury hazard to the children in care.
2. Staff #1 confirmed that the large storage bin was broken and unlocked.

Plan of Correction: The center responded with the following: The center will have the large storage bin immediately removed from the playground and thrown away. During the time of the inspection, the owner was able to call for a disposal pick up.

Standard #: 8VAC20-780-570-A
Description: Based on observation and interview, it was determined that the center did not ensure that when children are in the feeding tables the protective belt shall be fastened securely.
Evidence:
1. In the infant room, with children under the age of 13 months, the feeding tables did not have protective belt straps where children eat and sit together.
2. Infant staff confirmed that the infants do sit in the feeding tables without protective belt straps fastened securely.
3. Staff #1, owner, confirmed there are no protective straps to the children?s chairs at the feeding tables.

Plan of Correction: The center responded with the following: The center will purchase protective safety straps for each chair at the feeding tables and will ensure each child is securely fastened when sitting or eating at the table.
