Comments:

Licensing Inspector conducted an unannounced Religiously Exempt Code Monitor Inspection on May 8, 2023. There were 16 children ages 6 months to 2 years old present under the direct care of 3 staff. The Licensing Inspector reviewed 2 children?s records and 6 staff records, along with any requested program records submitted by the facility to determine if required documentation was complete. Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the program.CHILDREN Records Reviewed -------------------------

Standard #:	22.1-289.031-A
Description:	Based on inspection, the Center failed to post the fact that the Center is exempt from licensure. EVIDENCE: The Religious Exemption letter of certification was not posted.
Plan of Correction:	Certificate of Religious Exemption will be posted at the entrance of the day care center.
Standard #:	22.1-289.031-A-3-a
Description:	Based on inspection, the Center failed to maintain adult to child ratios for children ages zero through 16 months. EVIDENCE: Licensing Inspector observed ten (10) children ages 6 months through 15 months under the care of 2 staff. Center did not maintain ratios of 1 staff for every 4 children.
Plan of Correction:	At least 1 staff per 4 children ages zero through 15 months will be maintained at all times. Center Director will serve as an additional staff person for this classroom
Standard #:	22.1-289.031-A-4
Description:	Based on inspection, the Center failed to ensure each staff has been certified by a physician or physician assistant to be free from any disability which would prevent him from caring for children under his supervision. EVIDENCE: Licensing Inspector reviewed 6 staff records. Records for Staff #4 and Staff #6 did not include documentation of a health exam.
Plan of Correction:	Staff will complete physical examination from a physician. Documentation will be maintain in the staff record.
Standard #:	22.1-289.031-B-3
Description:	Based on inspection, the Center failed to have a t least one staff person certified to conduct daily simple health screening and exclusion of sick children. EVIDENCE: There was not at least 1 staff person present who has received training in daily health observations of children.
Plan of Correction:	Staff will complete the online daily health observation training.
Standard #:	22.1-289.031-B-6
Description:	Based on inspection, the Center failed to ensure that all staff are able to recognize the signs of child abuse and neglect. EVIDENCE: Staff members have not received training in recognizing the signs of child abuse and neglect.
Plan of Correction:	All Staff will complete a child abuse and neglect training. Center will include mandated report requirements to the staff handbook.
Standard #:	22.1-289.035-B-4
Description:	Based on record review, the Center failed to ensure out-of-State Background Checks are completed for each prospective employee, volunteer, or any other person who has lived outside of the State of Virginia within 5 years from the date of hire and who is expected to be alone with one or more children enrolled in the religious exempt child day center. EVIDENCE: Licensing Inspector reviewed 6 staff records. Sworn Disclosure Background Check for Staff #4 indicates that the staff person lived outside of the State of Virginia within the past 5 years. Out-of-state background Checks were not completed for Staff #4.
Plan of Correction:	The provider must send documentation to the LI that the background checks have been requested no later than 10 days following this notification date (5/08/2023)
Standard #:	8VAC20-770-40-D-2
Description:	Based on record review, the Center failed to ensure Background Checks are completed for each prospective employee, volunteer, or any other person who is expected to be alone with one or more children enrolled in the religious exempt child day center. EVIDENCE: Licensing Inspector reviewed 6 staff records. Records for Staff #2, #4 and #6 did not include documentation of a completed Central Registry Background Check.
