Comments:
An unannounced monitoring inspection was conducted on Tuesday, March 21, 2023 to determine the provider's compliance with licensing standards that could not be determined during the initial inspection. The inspector arrived at 8:20am and concluded the inspection at approximately 10:00am. There were eight children present, totaling 25 points, and three caregivers. The children were observed in the primary area of the family day home playing with toys and interacting with one another. All areas used for child care were inspected. The family day home has age and stage appropriate materials and supplies. The caregivers were observed having positive interactions with the children in care. The first aid kit and non-medical emergency supplies were inspected. Per the provider, transportation is not provided at this time and medication is not administered. A total of three caregivers' records and five children's records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-800-760-A-1
Description: Based on a review of emergency supplies and interview, the provider did not ensure the first aid kit contained the required supplies.

Evidence: 1) The family day home's first aid kit did not contain at a minimum two triangular bandages. 2) During interview, Caregiver #1 reported there were no triangular bandages in the first aid kit or anywhere in the home.

Plan of Correction: Per the Provider: "Triangular bandages was bought and placed in first aid kit."

Standard #: 8VAC20-800-120-B
Description: Based on a review of caregivers' records and interview, the provider did not ensure each caregiver record contained the required information.

Evidence: 1) The record for Caregiver #2, employed 03/06/23, did not contain the following - verification of age, job title, name address and telephone number of a person to be notified in an emergency; documentation that two or more references as to character and reputation as well as competency were checked before employment.

2) The record for Caregiver #3, employed 03/02/23, did not contain the following - verification of age, job title, name address and telephone number of a person to be notified in an emergency; documentation that two or more references as to character and reputation as well as competency were checked before employment.

3) During interview, Caregiver #1 acknowledged the required information was not obtained for Caregiver #2 and Caregiver #3.

Plan of Correction: Per the Provider: "Each assistant's file was reviewed after inspection and have been corrected of all required information that's needed to be in compliance."

Standard #: 8VAC20-800-40-A
Description: Based on observation on 03/21/23, the provider did not ensure that the total number of children receiving care at any one time did not exceed the maximum licensed capacity of the home.

Evidence: 1) On the date of the inspection, the inspector observed eight children in care, one of which was the provider's own child. 2) The family day home's maximum licensed capacity is five children. Excluding the provider's child, the family day home exceeded the licensed capacity of the home by two children.

Plan of Correction: Per the Provider: "Provisional permit given to inspector and approved 12 kids."

Standard #: 8VAC20-800-60-B
Description: Based on a review of five children's records, the provider did not ensure four children's records contained the required information.

Evidence: 1) The record for Child #1 did not contain written authorization of emergency medical care should an emergency occur and the parent cannot be located immediately unless the parent presents a written objection to provision of medical treatment on religious or other grounds; the first emergency contact in the record for was missing the emergency contact's address; the record did not contain the name, address, and telephone number of a second emergency contact.

2) The record for Child #2 did not contain the name, address, and telephone number of a second emergency contact.

3) The first emergency contact in the record for Child #3 was missing the emergency contact's address.

4) The second emergency contact in the record for Child #4 was missing the emergency contact's telephone number. The first emergency contact listed was the child's parent.

A child's record should contain the name, address and telephone number of two designated persons to contact in case of an emergency if the parent cannot be reached.

Plan of Correction: Per the Provider: "Received information needed for each file to be complete and in compliance."

Standard #: 8VAC20-800-170-A
Description: Based on a review of caregivers' records, the provider did not obtain from two caregivers at the time of employment and prior to coming into contact with children, a current report of tuberculosis (TB) screening form published by the Virginia Department of Health or a form consistent with it documenting the absence of tuberculosis in a communicable form.

Evidence: 1) The TB screening in the record of Caregiver #2, employed 03/06/23, was dated 03/09/23.

2) The TB screening in the record of Caregiver #3, employed 03/02/23, was dated 03/16/23.

Plan of Correction: Per the Provider: "To make sure TB test is completed before employee starts."

Standard #: 8VAC20-800-200-C
Description: Based on a review of documentation and interview, the provider did not maintain documentation that two caregivers completed orientation training.

Evidence: 1) The record of Caregiver #2, employed 03/06/23, and Caregiver #3, employed 03/02/23, did not contain documentation that the provider conducted orientation by the end of the caregivers' first week of assuming job responsibilities. 2) During interview, Caregiver #1 reported orientation was provided on 03/06/23, but signed documentation was not kept as required.

The documentation of the orientation should be signed and dated by the provider and assistant.

Plan of Correction: Per the Provider: "Orientation was given to assistants and signed."

Standard #: 8VAC20-800-570-A
Description: Based on observation, the provider did not ensure that a caregiver does not exceed 16 points.

Evidence: 1) When the inspector arrived at 8:20am on 03/21/23, there were seven children in care, totaling 22 points, with one caregiver. 2) During interview, Caregiver #1 reported an assistant was scheduled to arrive at 8:30am, but was running late that morning. 3) A second caregiver arrived at the family day home at 8:50am. It is estimated Caregiver #1 was over 6 points for approximately 30 minutes.

Plan of Correction: Per the Provider: "Assistants will arrive on time everyday by 8:30 to be in ratio."
