22.1 EARLY CHILDHOOD CARE AND EDUCATION

Comments:
An unannounced monitoring inspection was conducted today, October 24, 2023 as a focused follow-up to the issuance of a conditional license. The inspector was on site from approximately 10:10 am until 12:15 pm. The owner/ director was present and assisted with the inspection. There were seven children present, ranging in ages from three to four years, with three staff supervising. Children were observed finishing snack while listening to a story. Later children had time outside on the playground where they played with bubbles, rode small trikes, and painted bags to make pumpkins. Staff interacted with children in a positive manner.
The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of five child records and three staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

The violation notice of this inspection was amended on 02/15/2024.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on review of three staff records, the center did not obtain the results of a criminal history record information check and a search of the child abuse and neglect registry or equivalent registry from any state in which one staff member had resided in the preceding five years.

Evidence:

1) The record for Staff #2, employed 09/07/2023, indicated the staff had resided in three additional states outside of Virginia within the last five years.
2) The record for staff #2, employed 09/07/2023, did not contain a criminal history record information check or a search of the child abuse and neglect registry for the three additional states.
3) The out-of-state criminal history record information check is required to be obtained prior to hire. The out-of-state search for founded complaints of child abuse or neglect is required to be requested within the first 30 days of being employed.
4) The director confirmed the required out-of-state checks were not requested for Staff #2.

Plan of Correction: Per the director: Background request will be submitted .

Standard #: 8VAC20-780-160-A
Description: Based on review of three staff records, the center did not obtain documentation of a
negative tuberculosis screening for one staff member within the required time frame.

Evidence:

1. The record for Staff #2 (Employment 09/07/2023) contained documentation of a
negative tuberculosis screening dated 06/26/2023.
2.Tuberculosis screenings are required to be completed no more than 30 calendar days prior to employment and submitted at the time of employment.

Plan of Correction: Per the director: Going forward, we will get TB's prior to employment and within no more than 30 days prior to employment.

Standard #: 8VAC20-780-60-A
Description: Based on review of five children?s records, the center did not ensure all required information was obtained for each child?s record.

Evidence:

1. The record for child #1, child #2, child #3, child #4, and child #5 did not contain the addressees for the two emergency contacts listed on the each child?s record.
2. The record for child #1, child #2, child #3, child #4, and child #5 did not contain the work phone number and place of employment of each parent who has custody.

Plan of Correction: Per the director: We will update children's records with address for the emergency contacts and parent work information.

Standard #: 8VAC20-780-70
Description: Based on review of three staff records, the center did not obtain all required documentation for two staff records.

Evidence:

1. The record of staff #1 (employed 09/05/2023) did not contain documentation of two or more
references as to character and reputation as well as competency that were checked prior to
employment or volunteering.
2. The record of staff #2 (employed 09/07/2023) did not contain documentation of two or more
references as to character and reputation as well as competency that were checked prior to
employment or volunteering.

Plan of Correction: Per the director: We will make it a priority to complete missing references for the staff records.

Standard #: 8VAC20-780-240-B
Description: Based on review of three staff records and interview, the center did not ensure two staff completed orientation training prior to the staff member working alone with children and no later than seven days of the date of assuming job responsibilities.

Evidence:

1. The record of staff #1, employed 09/05/2023, did not contain documentation of orientation training.
2. The record of staff #2, employed 09/07/2023, did not contain documentation of orientation training.
3. The director stated staff #1 and staff #2 worked alone with children and had not completed the orientation training.

Plan of Correction: Per the director: We will make it a priority to complete missing documentation for the staff records
